My mother signed for Westgate in 2024 really because we was pushed into it I pretty sure everyone knows how they are. We told them no three times and they kept trying and we really wanted to go so we agreed not knowing what we were getting ourselves into. I paid on it for a little but I didn’t see much benefit so I tried to cancel they told us we were a week late I believe. And we were under the impression that we just couldn’t get out of it no matter what but because of bills and things we couldn’t actually afford it anymore we are literally struggling to pay our rent right now and now we got a letter stating they would be taking my moms taxes ? Thats literally our rent money for march! We hasn’t even paid January and it’s feb moral of the story is life took a huge twist and we have so many expenses and the economy doesnt help at all. We really need help getting out of this we are willing to do any steps we can we just need more knowledge please help us.

At this point, all you can do is stop paying them anything, take the credit hit from defaulting on the loan and maintenance fees and lots of mail and phone calls, and in 3-4 years they'll foreclose and take it back.

We haven’t paid it for almost a year and now we got a letter and it look like a w-2 so we was thinking they was gonna take her taxes for it

I second the previous advice. If you can't pay your rent, then don't pay the timeshare. You don't need the timeshare but you need a place to live. As for the letter, I would be very suspicious of this. They can't take your tax refund or garnish your wages without suing you.

What was the actual name of the form or letter? Was it perhaps a 1099-S or something similar? Actually knowing what it is is important. What exactly did the letter say. Perhaps you could take a photo of it, block out private stuff, and post it here.

Was the letter from the loan company? Have you been sued? I would think they would need to do that to garnish any wages etc.

Yes, certainly don't talk to any timeshare exit companies. They can't do anything for you that you can't do yourself for free. They will just have you continue non payment and Westgate will eventually foreclose. You are already doing that and don't need to pay thousands more to continue doing it.

The letter is very likely just the process of starting default and foreclosure notices. Though without seeing it, we don't know for sure. Foreclosure can be a long process. Lots of threatening letters and phone calls. You have protection under the Fair Debt Collection Practices Act to ask them to stop calling.

they will not take her taxes. But they may issue a 1099 like the credit cards do when they cancel someone's debt. A lot of people who have their credit card debt cancelled are shocked when they receive it and do their taxes and end up owning thousands in taxes.

Yeah, that would be a 1099-C. It can have tax implications and one should consult a tax professional as the tax implications may be able to be avoided.
