How to cancel timeshare upgrade

Hi I just purchased an upgrade and wanted to cancel it i mailed the letter a day late from the recission end date

I signed the contract 12/19/2018
They said the end date would be on 12/23/2018 (sunday)

I only checked the contract 24th which is Christmas eve I found out that I was lied to saying I was saving more money because they are lowering the interest rate and saying that in my previous contract im paying the same amount with the upgrade and they also told me that they are giving 45,000 point/rewards for the wyndham rewards card to use on my maintenance fee only to find out from a letter that I wasn’t approved for that card

I called as soon as i found out talked to the lady who helped me sign the contract she said I am cleared and good to go because of holiday so i dropped my mail at post office that same day monday the 24th how ever post office is closed already.

The letter ended up being postmarked as 12/26/18

And they said I am now unable to revoke the contract I dont know what to do all i wanted was to cancel my upgrade. Now i feel like forfeiting everything i paid for and just cancel all of it.

What should I do?

An upgrade is essentially a new purchase. Each state sets the legally mandated rescission period. If you cancel within that period you would revert back to the pre-upgrade contract. If you do not rescind during the rescission period, you missed your opportunity to cancel. Your contract would have included the rescission period. Some states count only business days while others go by calendar days for rescission. At 3 days, you bought in one of the states with the shortest periods.

Your options are
1.Pay off the upgrade and then at that point keep it or turn it back into ovations.
2.Refuse to pay any more- Wyndham will cancel your reservations and not allow you to make any new ones and will eventually offer to cancel your membership if CWA or offer a deed in lieu of foreclosure for deeded contracts. This will likely effect your credit- to what extent - it depends.
3.Throw yourself at Wyndhams mercy and see if you can negotiate a return to the original contract based on your financial situation. This likely won't help but they may see if there is other financing offers.
4. Take legal action if you think you can prove fraud. This can be costly and unfortunately it doesn't matter what you were told, it matter what the contract says.
 
Maybe you can use the not qualifying for the rewards card as an out because Wyndham didn't live up to there end of the contract of awarding you 45,000 reward points. Is the reward points spelled out in the contract?
