HGVC Rescission

Hello all,

New member to TUG and first post to the forum. I signed up for a timeshare with HGVC in Las Vegas for a Las Palmeras property. The deal was 5440 ClubPoints every other year for a total of $15,600. I put down a down payment of $2332.83 on my Hilton Aspire Card. I made the deal on 13 November 2022. After watching YouTube videos from The Timeshare Traveler and reading threads on TUG, I decided that a timeshare would not fit my current lifestyle. On 18 November 2022, I signed the rescission form provided for me as a California resident and downloaded the updated form from the state attorney general's office; both were sent with an original contract. I then made a copy of everything and kept the copied contract and the signed rescission forms. I bought overnight shipping with USPS, as advised by the TUG gurus, but the package was delayed as one can see from the attachment. It was received after Thanksgiving. I still have not heard anything, and my 1st payment notice was on 28 December 2022. The 1st payment will be past due on 8 January 2023. Should I make the payment or still wait the obligated 45 days?

I am not an attorney so don't take my comments as legal advice, but it seems to me that because the delivery was delayed, HGV may have assumed you did not rescind in time and did not process your rescission. I would contact HGV with proof that you did indeed send your rescission in time and that it should be processed. And under no circumstances would I make a payment, as that could be interpreted that you believe the sales contract is still valid.

@PigsDad contact the HGVC customer service through the HGV app? I have "unable to sign in. Your account has no HGV Memberships. Please try again later." Are there phone numbers or emails on TUG that will get me to the source of solving this issue with HGV?

@GT75 unfortunately, my down payment has not been refunded. Are there phone numbers or emails on TUG that will get me to the source of solving this issue with HGV?

What is important is can you prove the Mailing Date?

The Mailing Date is the important Date. Not the Receipt Date. Not giving Legal Advice but a Mailing is presumed received on the Date of Mailing. Years ago I had problems with a Timeshare Company because everything was mailed to a Post Office Box in San Francisco but their Office was in Las Vegas. 3 or 4 days a week someone would pick up the Mail and transport it to Las Vegas. Then it might take several days for the Mail to be opened and Posted to my Account. I called upset because of some late fees that were added to my Account. This was how I found out about their System. The person I talked to was pretty low level and did not understand the term "posting to my account." She thought I was talking about the Post Office. I started enclosing a Certificate of Mailing with each payment. I could not understand how inefficient they were. At the time I was an in-house counsel for an Insurance Company. All Mail was opened on Date of Receipt, added to the Account File that Date. Any payments received were Posted to the Account on the Date of Receipt.

I finally got confirmation that they received my rescission paperwork, but it was an obstacle course of phone calls.
First, I received a call from loan services on 3 January, asking about my 28 December payment for my contract. In that call, I told them about my rescission paperwork. They told me they would do an investigation after I sent them my documentation to the email address: gvs@hgv.com. I sent them a PDF of my USPS receipt, USPS online tracking confirmation, and my rescission letter. Forty-eight hours later, nothing was heard, and no refund of my down payment.

This morning 5 January, I called the numbers @GT75 posted above. The most beneficial number was loan services, [Loan Services, call 800-472-6387 (US & Canada)]. Loan services put me on hold and confirmed the tracking number, and their possession of my rescission paperwork was sent during the required timeframe. However, loan services told me to call the HGVC sales office, where I made the contract to get them to cancel the loan. At the time of writing this post, that sales office is closed until later this morning. I guess I'll call later and send an update afterward.

Ugh!!!!!! There should be no need to contact the sales office. The only reason for that is to get you to pull back on the recession.

The sales office doesn’t handle that paperwork. That is why they are called the sales office. They will only try to talk you out if it.

I would call the loan department back and tell them to refund your money. Talk to a supervisor. Someone might know for sure, but I thought that they have 45 days to refund your money.

Or better yet, you proved that they have the paperwork and are legally required to cancel TS purchase. So you can sit back and wait for the refund which they are legally required to do. And they will.

So disappointed in HGV right now. This is something I have never heard them do before. CSR was usually so helpful, but this makes me sad. A rep that’s not in sales openly lying about how to handle a recession. Things just keep getting worse with Apollo involved. Not what I wanted to hear.

I'd think any person at a timeshare sales office would be more concerned about having what they say recorded...

@GT75 My refund and contract were officially confirmed yesterday via email. How I eventually received the email by calling loan services again yesterday morning. On the call, I told them I could not get ahold of the HGV office where I officially made the contract in Las Vegas. Loan Services did say the refund was being processed; however, they sent an email to the Las Vegas HGV office. Yesterday afternoon I received an email from that office and an attachment of the refund receipt. The email said my contract was canceled, and the refund could take 2-3 months.

Great news, but did you get your refund also? I am certainly not an expert on this, but I don't think that 2-3 months for a TS refund is w/i legal timeframe. I thought that it was 45 days (but again, that is just my memory reading threads here on TUG. Sometimes (well many times) my memory does fail me.

Either way, you can certainly now celebrate. Now, if you still like HGVC (I honestly think it is a great program), take your time and research and buy resale. But there are also other great TS systems out there too. So research them all and buy what is right for you and your family.
