Need a recommendation for a lawyer/law firm to represent us in a civil and criminal timeshare fraud suit in Quintana Roo. Must be lawyer/law firm that will attest to the fact of having no conflict of interest in having represented in the past or present a timeshare entity whether a seller or a company part of the timeshare industry.

We have filed a complaint with Profeco and after several meetings need to prepare for further legal actions. Thank you.

How did this company wrong you? What are you hoping to accomplish by filing a civil suit?

I'm not telling you don't do it. I'm just saying that these lawsuits rarely have great results for the plaintiffs.

Are you prepared to go through a lot of time, expenses, and rigors for this with only a possibility that you'll get a satisfactory settlement?

Are you a resident of a country other than Mexico? If so, are you sure you want to pay legal fees in order to attempt to navigate the legal system of another country? Your chance of success is quite low.

How much have you already spent on the timeshare? Its possible that the legal fees would exceed what was spent on the timeshare.

I would like to suggest you ask a moderator to request that this thread be moved to the Mexican Forum on TUG.

I think you may find you get more views and responses there.

Best of luck!

I am a permanent resident in Mexico. My wife is Mexican. We have attended several meetings with Profeco, our 5th is going to be on Dec 19. Sunset Worlds Group (Resorts) has a very long history of receiving complaints. Ours involves fraud including lies, intent to deceive, and illness as a direct result of the stress caused (circumstantial evidence submitted to Profeco). Mexican law including contract, civil, and criminal law is in our favor. Finding the right lawyer (firm) is the key. The timeshare company will be happy (not serious) unhappily cancel our contract, but will not return our investment of $18,475 US. They have been fined twice by Profeco for not appearing for meetings. Profeco sent our case to a higher official because of allegations company has a history of complaints under different names. Need to sue for compensatory and punitive damages as well as to make us whole again. The lawyer/law firm will benefit from this case as the publicity will be enormous and probably appear in every travel blog and periodical internationally. Because one plaintiff involved was over 80 and not in full possession of his faculties (article presented as evidence), Mexican law takes this into account. Most people cave in to the benefit of the defendant, permitting the creation of more and more victims. This victim, considering the flagrant violation of the law, recognizes that the defendant counts on the difficulty of adjudicating cases in Mexico and therefore will refuse to settle unless taken to court. Profeco is just an agency to mock as is Mexican contract law.

Mex Law they have offices in Playa Del Carmen and Cancun.

Mex Law seems like a worthwhile suggestion as further litigation might be necessary in Florida.
