Help me understand the process.

I purchased a Wyndham Kona Hawaiian 231000 points resale. The transfer is in the process and will not be completed for a while. I need to understand the process for the following before calling Wyndham so I know what I am talking about.

I spoke with the seller and we agreed on his making a reservation for the week I would like to use. The unit I purchased is a every other even year. I would like to use it the first or second week of Sept. 2010. Please correct me if I am wrong on the following. To reserve that week he would

1. be able to call the first week of Aug 2009 to reserve. Will he have to put it in my name or would it be in his name with me as a guest.

2. The sale included me having to pay the 2009 maint. fee which is in escrow. the selller informed me that he has made a payment through July 09. which he pays monthly. I would think the maint fees would have to be paid in full through 2009 in order to make the reservation. Is this correct?

3. I would have no problem paying the Aug through Dec. maint fees which is about $225.00 so the reservation can be made. Would Wyndham except payment directly from me by credit card? or, would I have to send a check to him so he could make the payment.

Is there anything else I should be aware of.

Having not been in your situation I have not tried to do what you are trying to do. Normally and Owner can ARP the first day of the 13 th month prior to the start of the planned vacation. However, I have heard from at least one Seller that Wyndham currently will not allow a reservation to be made for the new owner while the contract is in ESCROW or in the process of being Transferred. Having said that, I question the effectiveness of such a policy if you are truly buying from the current ACTUAL owner who has a paid up account with a membership number open to reserve whatever he wants.

If you and the OWNER have such an agreement it appears to me that the simplest thing to do is have the OWNER purchase a Gift Certificate (roughly $100) and make the reservation on August 3, 2009 or August 10, 2009 to get what you want in YOUR NAME.

No! The maintenance fees are paid monthly in and do not have to be paid in advance through December, 2009 to take advantage of the ARP benefit that is available beginning August 1, 2009.

You have already paid the balance of the 2009 maintenance fees into Escrow and you have no further obligation regarding those fees. Wyndham only requires that the current Owner be current with Maintenance fees to make an ARP reservation for 2010 and it appears based on the facts presented that he is current.

Have you received a copy of an Estoppel Letter signed by Wyndham? An Estoppel Letter would put your mind at ease regarding the status of maintenance fees, the availability of the points in 2010 and the status of the current owner's financial obligation (if any) to Wyndham. You do not have to call Wyndham to get such a letter the Closing Company or the Seller should be able to get you the Letter at a cost of no more than $25.

You are not at this time Owner of the Points and it would probably do you no good to call Wyndham inquiring about the week you want or to inquire about the status of the transfer. While things are being processed it appears that all you can do is what you are planning to do with the current Owner's
cooperation.

Thanks for the input Dave. I did receive a copy of the estoppel before the current owner paid the fees up to july 09. The owner only paid the fees to keep the account current since I was to pay for all of 09 which is actually in escrow. When the closing got delayed (long story) I contacted the owner and worked out his ok to reserve in my name. I am not sure but that may be why he paid the fees in order to be able to book the reservation in Aug since I told him if I was not able to use the week I purchased I would back out of the purchase. I figured Wnydham would not deal with me direct. I was pnly planning on calling them to find out what options were avail to someone in this situation & just needed to understand the process before I called. I will have to ask them about what you mentioned about not allowing reservations while in escrow or the process of being transfered. Thanks again
