Hi,
Someone on the trip advisor board directed me to this site. I need some advice quickly please!

I was in Mazatlan Mexico with my wife last week. We signed up for a timeshare at Torrenza, with the following promises:
1. My existing Bi-Annual Time share would be purchased through Sierra Club within 150 days. Price promised to pay was our original purchase price 2 years ago.
2. We would get 2 grand a year for not using our torrenza time share for the next 5 years. ( We signed up for 2 weeks a year)

Now that I have gotten home, been contacted from Sierra, I don't feel confident at all.
First off, I have one contract (the 3 page contract listing terms etc) that checks off "RED" time. But on the 1 piece of paper with fiancial info on it it says "WHite" Time. I did not catch this until now. I called Torrenza and they said it does not matter since we are depositing the weeks, but I am very uncomfortable with that response. I cannot vacation in June or September-the white months!

I was supposed to get my first 2000 in 90 days for depositing this years weeks at Torrenza according to Trevor the sales manager. Now Sierra is saying I will not get it until next year. I am also learning that it is a trick to promise to sell my other timeshare, and I have no faith that they will be able to sell it for the price promised.

What options do I have? My 5 days window is up, but I feel like I have been lied to and tricked? Can I have my credit card reverse the down payment?
Do I have a leg to stand on? My only hope with the dispute, is that on one contract it says white time, the other says red time.
I feel so sick to my stomach right now. Thank you to anyone who can give advice!

I hate the thought of this-but if they cannot sell my other time share as promised do I just eat the deposit and cancel?

Please do not reply if you are just going to say I was stupid to sign without doing research-i feel bad enough already

Mexico has a TS fraud division of their government called Profeco

Here is info about rescinding in Mexico thread

I'd send the letter to rescind NOW even if you are over the five days. Can't hurt. Then contact profeco.

Despite the circumstances, welcome to TUG. I think going by your last sentence, you are thinking of other bbs because I don't think you will find a more helpful group of people than here at TUG. Also, many, many posters went through similar situations. As Bill mentioned, send your letter to rescind immediately and contact Profeco. Also, contact your credit card company to dispute the charges. If you haven't already done so, document every contact regarding this problem so that you will have a history in writing. Do not delay in any of this as time is working against you.

You might also want to visit the Mexico forums where there will be many who have gone through similar experiences.

Chrome.....This is as I told you...Only helpful people here....Do just as is stated above....these folks know their stuff as I told you.....I told you I would look for you over here...so now jump into action! You will do much better over here than on TA....I know for a fact!!! Hang in there, do as they advise...getting sick over it is not going to change anything, but the recommendations above might....

Later on you may even want to spend more time over here....this is a fantastic site with the best, helpful people.....and no they will not condemn you......Welcome to TUG!!!! Good luck.......

You need read your contract, and follow their instructions

On how to rescind your contract. You also need to send copies to Profeco
As to what exactly you need to do, you have to read your paperwork,, no one else can do that for you as you are the one with the contract.:D
Profeco is a great agency, they are methodical, and will seem to be taking for ever, but they are you best hope of unwinding this package.

We had same experience in March 09. Wish we had viewed scam notices online. We have started credit card dispute but will see. Please let me know if you find any success anywhere.

We were promised very similar things
Guaranteed Rent of 2 bed unit for $5k/yr net of maint fees
2 additional weeks from trading places that could be used guaranteed at the sister locations
Maint fee only due if used
Buidling would be completed in 18 mos or huge fines
PROFECO signs were signs of approval of their program
purchase at outrageous prices of our current timeshares - consolidation sounded good to us
Fractional Ownership Not timeshare? whatever that means
We pre-paid Sierra their subsription service fee $688.85. Were told by them they would refund if Torrenza refunded

Torrenza tried to run our credit card for remainder of payment but it was declined thankfully.

Would be happy to provide any details or info in order to help you and me see if there is a way to reverse this transaction.

Chrom.... don't feel bad. These people are pros.

Follow the directions in the contract to recind. The letter does not need details or fluff just "we recind the contract dated xx/xx/xxxx between John doe and Mazatlan" but make sure you read the details in the contract.

If you paid with a CC start a dispute.

Good luck with everything.

Welcome, Chrome....sorry for your experience, but know that you are not alone in having done this very thing. Follow the advice of those who have been there, and the rest of us will cheer you on. Learn from this group, and when you've done your homework you can purchase a timeshare you'll enjoy for years without breaking the bank. Good luck!
