Hi all!
I am having difficulty finding an answer online. Does anyone know if timeshare sales are governed by property laws in the state in which the timeshare sale occurred or the state in which the purchased property is located? If you have sources I can review, that's great!
 
It depends on what law you are referring to? Are you talking about the sale and purchase? It may be both. If it is about rescission, then it likely applies to both. So if one state has a 5-day rescission but the timeshare is located in a state with a 10-day rescission, then you should have 10 days to cancel.

Don't think so. The rescission clause would conform to laws of the state in which the contract was formed.

From what I've seen in several contracts, there is an addendum for the state where the property or timeshare system is located. We see this often with Marriott, Westin and Sheraton points programs that are all setup in Florida but sold nationally.
