FREE Caribbean Palm Village - Aruba

I have an inherited timeshare at Caribbean Palm Village in Aruba. It is a 1 BR/ 2 BA with Kitchen. The timeshare is paid for (no loan/mortgage) and all fees are up to date.

Fixed week: 27
Alternate years: Odd
Maintenance Fee: $624 (Due every other year - next due Jan. 2011)
Transfer Fee: $2000

There is a one time special assessment of $285 due Dec. 31 of this year (according to letter for renovations). It's been in my famiy 10 yrs and this is the first time I know of that they are charging a spec. assessment during this time.

Does the resort charge a $2,000 transfer fee?
 
Unfortunately it looks like they do. I will double check on Monday since this seems to be one of the higher transfer fees I've seen.
 
Have you already recorded the deed in your name? Are you aware that you do NOT have to accept this inheritance if you don't want it?

I got it a few years ago when I was still in school, so not an option. (If only I could go back in time!) Although it's not in my name I am the executor so I have to deal with it.
 
To be quit frank with you, this resort does not have a high rating and with the $2,000 transfer cost, it's going to be impossible to get rid of it. The market is flooded with cheap and free resales right now, and no one is going to pay $2,000 for the transfer.

If I was you I find out about deeding it back to the resort. The first thing I would do is contact them and tell them the owner is deceased and that the estate is deeding it back to them. (Don't ask permission - tell them that's what you are going to do and be firm.) Be sure you talk to someone in authority. They may go along with it if they realize that you are not going to continue to pay the maintenance fees.

If they refuse it, you will need to get legal advice, but you do NOT have to accept this week yourself. If you record it in your name - you will be stuck with it forever! Don't do it!

Ok. Thanks for the honest reply. I've looked into doing that but from what I read thought my chances were practically nil. We'll see.
 
Legally, no one has to accept inherited property that they don't want. So no one can make you accept it personally. Once the resort realizes that you aren't going to accept it or continue to pay the maintenance fees, sometimes they will just take it back to avoid taking the estate (not you, the estate) to court.

If they refuse it and won't back down, I'd ask a real estate attorney about doing a quit claim and deeding it back to them. The resort doesn't have to accept it, but once they see that you are serious, they may do so anyway, to avoid future collection expenses.
 
Definitely legal advice required. In your name as executor is a lot different than in your name as beneficiary, at least in my neck of the woods.

I am a long-time owner at Caribbean Palm Village and I can tell you that there is no $2000 transfer fee. There was a specific situation at the resort that caused the Board to put this rule into effect for a couple of weeks but they soon realized the error of their ways. No one was ever charged the fee.
By the way, it is a lovely low-rise resort. The only problem for some people is that it is 1 mile from the beach. Most people rent a car so this is a non-issue.
 
NYLady, I also own 2 timeshares in Aruba, Playa Linda and LaCabana but am not familiar with yours. I am always looking for a good deal to add weeks to my existing ones and your weeks would work perfectly. Where exactly is the Caribbean Palm located and which beach is the closest. I am very familiar with Palm Beach and Eagle Beach ares. Also, do you have any privileges (palapas, etc) at the beach?

Just joined TUG. I guess unless people remove or update their posts there's no way to know if they are still active or not. I am just learning how to navigate thru all the info.
