A friend of mine is going thru and interesting situation with her 20 yo daughter. Seems she had a fake driver's license showing an age of 21 yo. She normally carries the original license along with the fake license. I use the word "had" because she let the two licenses out of her possession for a couple of hours while boating. Turns out the local police found the two licenses and wants to talk to her about "a possession of hers". :doh:

I hope she lives long enough to talk to the police as her mother might cut off her head and fill her throat full of newspapers in the meantime. Oh, BTW, the daughter works at a government institution with a Top Secret Clearance. :shrug:

That certainly was a stupid thing to do for a couple of beers. Nothing like trashing your job so you can get trashed a little ahead of time.

But your job might not have hinged on getting caught. I know when I was 20, if I had a fake ID and got caught with it, no one where I worked would have cared unless they thought it was good joke material.

if its her first offense for anything...even if she gets arrested she will be offered something called "pre trial intervention" where she can plead no contest and it wont show up on her record and she can choose to do community service.

I am not sure how an "arrest" however would impact her security clearance...id imagine it would most certainly be at risk.

(even ive been 20 and caught with a fake id) =)

Okay, I guess it's time for me to fess up and admit to having a fake ID when I was 17 - this was back in the days when the drinking age was 18. :D Actually it wasn't a fake id - it was real but it belonged to a friend - there were no pictures on driver's licenses then and I used hers to get into a local establishment. But with my luck my brother (who was legal) happened to be there and threatened to tell mom unless I left immediately and never came back until I was 18. That was enough to scare me! LOL.

Been through that with children, don't want to do it again. Did you hear the story about the security guard at Boston College who had Tim Russert's son's fake ID. It seems as though he took it up when the son was a freshman and saved it to give to Tim so it wouldn't hit e-bay and the news. He gave it to Tim at his son't graduation. If this is the worse that the young lady does, I think her life will be ok. Now that my children are grown, I'm amazed and proud of the values they hold to be true.

This is indeed her first offense so under normal circumstances and with a good attorney (and the fact that she's a blond) she could get a break. However, the jurisdiction is in the red-neck part of Virginia. Hopefully it's Barney Fife and not the hanging judge. Moreover, after 9/11 the whole issue of forged ID is not what it used to be.

With regard to a current security clearance, I'm not sure how one's record gets updated to reflect a recent misdemeanor. Back in the days when I had a Top Secret clearance I was extremely careful not to jeopardize that aspect of my job. Oh, and for the daughter this is about the lowest level of security clearance for this Federal entity in Virginia on the outskirts of Washington D.C.

Why is the mother so involved in the problem/solution? Even blondes have to begin to show personal responsibility at some point in their lives, and twenty is more than old enough.

She's caught, no two ways about it. Now she has to figure out the best way for her to be able to deal with it. Hopefully she'll be offerred some diversion program/community service and (if she is real lucky) perhaps have it expunged after that.

And maybe, just maybe, she'll learn from it. If her mother lets her...

BINGO!! That's the same advice I have provided to her "mommy".

Now let's add another twist. What if the daughter's career path is to be a CPA, etc. with a major accounting firm! :doh:

If she just HAD the fake ID, and wasn't using it to buy alcohol or for any other illegal purpose, is that illegal? And how did the police get ahold of the two IDs? Did they have a warrant to go through her purse?

I believe the Virginia statutes speak to possession of a fraudulent ID. Let's just say the method of obtaining the 2 pieces of ID were totally legal. No warrant was even needed as the IDs were left out in the public for anyone to come upon them.

Again, STUPID IS AS STUPID DOES.

While I completely agree with you Fern...I have a 20 y/o right now and it gets a little complicated when you are dealing with your own. It sounds like the one we're talking about is largely responsible and has been on the path to having her own life. Mine is just a clueless college kid. As Judge Judy would likely describe him, he is not fully cooked yet. My wife and I committed to support him through college, but there are many days where we simply want to throw him out on his ears. (sigh)

I have to contrast him though to the 30 something y/o baby across the street who constantly makes bad choices, argues with his mom loudly outside and basically sits around the house all day complaining that none of his situation is his fault. He wound up spending a few years in jail for drug trafficing at one point in his life, and learned nothing. Compared to that, we're blessed!

I was once pulled over by a cop and he asked to see my DL. It just so happened that for just that unique moment I had my wife's DL also. The cop advised me that I cannot have 2 DL on my possession. I reminded him that the second one belonged to my wife and explained the circumstances. He was sufficiently mentally challenged to just be able to read the law but had left his common sense at home in his tent.

My bet is that if she goes in with a good attitude, is polite, shakes hands, dresses professionally, apologizes, says she knows it was poor judgment, and perhaps looks very scared (which I hope she is) she'll get a little slap on the wrist and that'll be that.

If the law is you can't have two ids on you, and this is her first offense, she might get off with just a wrist slap. But what if one of those ids is falsified? Wouldn't that come with some kind of stricter penalty?

Darned if I know for sure, but in many situations the police have discretion about whether or not to pursue matters, or how to pursue them.

I wonder if the police noticed that one was fake? Perhaps they only want to question why she had two. :shrug: And since they weren't technically "on her," she isn't guilty of possessing two IDs, right? At any rate, I'm sure she's learned a valuable lesson... don't leave your fake IDs laying around. :D

Okay, I work for a criminal defense lawyer and maybe that's why this is what comes to my mind: Who is to say that she made the fake ID? If someone stole her drivers license and she hadn't realized it was missing and the thief was in the process of making a fake ID off of her real ID how could they possibly prove that she was the one who had the fake ID made? So hopefully she hasn't spoken to the police yet and, when she does, she says she lost her license and had not had a chance to go to the DMV yet.

While many of you may not totally agree with this excuse, I also make it from the point of view that when I was 18 I had a fake ID until I was 21 (it belonged to my sister's friend who looked like me). I did not drink, I just loved going to nightclubs to go dancing and at the time I worked 60 hours a week and was otherwise a "good kid". So while I was doing something illegal (using a fake ID to get into nightclubs), I was actually more responsible and behaving better than a lot of the friends I went to high school with who drank at house parties every weekend. So to me, having a fake ID, at least from my own experience, did not make me this terrible kid, I just loved to dance. I for one hope she doesn't get in trouble. She sounds like a responsible kid and any kind of criminal arrest on her record would affect her future. This is just too dumb of a reason to affect an otherwise seemingly responsible kid's future.
