Wondering if anyone has recently had a similar experience. I am Canadian and own a timeshare in South Carolina. It is all paid for and have had it for 20 plus years. We are no longer able to travel to the US . I sent a letter to the management of the company in January advising that we would not be paying the MF fees going forward as we are unable to sell or rent the unit and have not option but to default to foreclosure. I heard nothing back from the company and a few days ago I received a notice of collection from a Canadian collection agency for the maintenance fees plus a penalty fee.
Looking for someone who may have gone through this or has advice. I am leaning to ignoring it all!

Hi fellow Canuk! :wave: Read through the pink 'sticky' at the top of this section for the Timeshare Default Credit Report for reports of Canadians with US timeshares who stopped paying maintenance fees. It is pretty widely known that very few companies (timeshares incl) will chase a debt into a foreign country due to the very lengthy, complicated and costly legal paperwork involved. Folks often get threatening letters and or phone calls but rarely any action. Credit agencies in both countries do not share information with each other.

Also having an outstanding debt can not affect your ability to enter the USA on future vacations since the Customs & Immigration computers in either country are in no way connected to any financial institutions of either country.

Have you tried posting your timeshare on the Free Giveaways section?

Is the timeshare Hilton branded? If so, it may have value and you can sell it.

I was just surprised mostly that the letter of collection came from a Canadian company???
Write them back demanding proof that you actually owe the debt to them. If the debt is owed an American company, let them prove it. My guess is that the debt was purchased from the resort (U.S.) and they have no proof that you are responsible to them. The U.S. resort got what they thought they could from the Canadian collectors. Either way, there is no collateral for them to seize/liquidate. I see no way to damage a Canadian that simply wants out.
 
Wow! Ironically I'm just in the exact same situation. Based on what I have been able to gather from this group, yesterday I asked my lawyer to have a look to see if the Canadian credit collection agency has any ability to collect for an American timeshare. I will write to ask for proof of debt and will keep posting with any updates.

No they dont. I have a friend who worked for Equifax (in ON) for may years (but retired close to 20 yrs ago) and said it couldnt be done in either direction. Also, our oldest DS was transferred to FL for his job and had to start with a zero credit rating even though he had a very high rating in ON. He couldnt even lease a car because he had no credit in the USA! His employer gave him a letter with his salary and particulars about his job transfer to take to the car dealership and bank but they didnt care. He had/has TD Bank account in both countries and it took some doing to get him approved for a US bank credit card with just a $1000. limit when he first moved down even though he paid cash (transfer between countries) for his FL house after his ON house sold.
