Has anyone used or know any information about an advocacy company called Cancel By Owner at cancelbyowner.org. We are trying to rescind a contract for a recent timeshare and I have contacted this company, but am reluctant to provide monies without some knowledge of the company.
 
No one here would pay an upfront fee to cancel a contract:

1) The fact that they want an upfront fee is a big red flag
2) You have no legal grounds to cancel your contract
3) Once they have your money, how will you get it back if they don't perform as promised? Do you have the money to hire an attorney and file a lawsuit.

The duty of CUSTOMER and to maintain confidentiality of information under this section continues beyond the term of this contract, or extensions or renewals of it.

REFUND POLICY: All timeshare contract cancellations occurring after date entering this contract constitute a release secured by Cancel By Owner. Should Cancel By Owner not secure the termination rescission, release or cancellation within 12 months of the date of this agreement (providing the CUSTOMER has fulfilled their responsibilities) Cancel By Owner will refund 100% of your money. CUSTOMER agrees to cooperate fully and completely with Cancel By Owner. CUSTOMER hereby agrees that, if such cooperation with Cancel By Owner is withheld, Cancel By Owner may, at its option, either individually or collectively, terminate affiliation by notice in writing to CUSTOMER. IF so notified, CUSTOMER shall immediately pay Cancel By Owner all fees, costs and expenses incurred and any amounts due to others.

Cancel by Owner appears to be related to Timeshare Advocacy Group as their websites share many sentences word for word. Not surprisingly, Timeshare Advocacy Group has an alert by the BBB that states they have return mail and that it appears they are out of business.

Sorry, you're out of luck in that quest.

You're apt to find a company like that about the same time you encounter unicorns & leprechauns.

Meanwhile, the desire to get out from under burdensome full-freight timeshare purchases after the rescission period has come & gone is so strong among so many that the hornswogglers & bamboozlers out there are able to keep on bilking the timeshare buyer regret crowd.

Unfortunate, but that's the way it is.

There are plenty of firms that will help you rescind a contract without an upfront fee if you are within your rescission period. If you are outside of your recission period, then you own it.
 
If you are within the legally required 'cooling off', or rescission period, you don't need help in cancelling the contract. Just follow the instructions contained in the packet of papers you signed.

But if you signed a legally binding contract, and allowed the rescission period to expire, best hang around TUG and learn how to get the most from your new timeshare. You saw value in the presentation you attended. There may have been exaggerations and promises of benefits made that are not contained in the contract. That's why you have between 3- and 10 or more days to review the contract and either get it amended or cancelled.

Above all, DO NOT pay anyone anything upfront to cancel, or 'get out' of a legally binding contract. We've heard of hundreds of these schemes, and all are scams designed to separate you from even more of your money. Once they have your money, there is no incentive to do anything to deal with the timeshare corporations. In other words, you'll still own and owe for it. About the only legitimate cause for cancellation is fraud, and that is very hard to prove, unless you have written or recorded evidence of it. The written contract has precedence over any verbal agreement.

You are better off putting the money you would pay a company to try and use the money towards the contract towards the morgage.

You bought the timeshare for a reason, enjoy it. If you no longer want all of the vacations it can get, check with family and friends and see if they would want to use it for shared maintance fees.

I would not think firms that try to break the timeshare contracts for a fee are consumer advocacy groups. They are just business.
