Canceling bluegreen vacations!

We got guilted into buying in during a presentation on the 21st. After researching more that night I got really bad feelings and found a post on here on how to cancel during the 10 day period since we bought in Florida. I sent the package on the 23rd overnighted and it still hasn't arrived. I'm getting worried now about if they don't receive it or it gets lost. Any help would be appreciated. This is what I sent.

This letter is to inform you that we want to exercise our right of rescission to cancel our timeshare contract immediately that was purchased on February 24 of 2018 at the Bluegreen Vacation Preview Center in Savannah, Georgia, contract reference number XXXX, in accordance with the laws of the state of Georgia. We want a full refund of the initial deposit amount of $XXXX that was paid with a visa card ending with XXXX. We also do not authorize any future additional charges to our bank account or credit card.


All items that were given to us from the purchase of timeshare are included in this package along with the cruise certificate benefit.

I hope that this will be good enough to get us out of this nightmare.
 
You should follow the rescission instructions to the letter. I’m not sure what method you used to “overnight” it, but really what you should do (and you still have time) is send it by certified mail, return receipt requested, through the US mail. If you used a different method other than USPS, I’d go ahead and send another letter with the same contents **to the address listed in your contract** making sure that everyone who signed the contract also signs the rescission letter. Other than that, you’re good to go. Congratulations on saving tens of thousands of dollars.

Wait, i just read your post again. It references a purchase date of February 24, 2018 in the State of Georgia? Did you copy/paste the wrong thing?

I sent the letter, the books, the cruise certificate all in a express mail overnight box, with signature and delivery receipt requested. Me and my.wife both signed the letter. If It hasn't been delivered by tomorrow morning I'll right another one and just mail the letter separately by itself how you instructed above. But otherwise if all goes well and rhe receive it, I should be good to go right?

Yes sorry I just pasted the template all the dates and amounts have been changed for my own.

I did put October 21st, 2023 and Florida in the letter I Sent, and my down payment amount and mine and my wife's names.
 
@Darthcody94 You should be fine as long as you sent the package to the correct address (the one listed in the contract). The only date that matters is when you sent the letter, not when they pick it up.

I'd have preferred to just send the letter in an envelope marked 'Rescission', so doesn't get delayed by some clerk pawing through their junk. They will eventually find it and process the rescission, but you'll have some stress before they do.

If you sent it via us mail you should be fine.

Did the contract specify a method of mail? I agree with the above poster, for the peace of mind, may be worth sending it certified, but you’re most likely fine either way.

It did not specify I just reviewed the page again ( I took pictures of everything I sent) it just says please send in writing to (address) and it shall be effective upon date sent.
 
You should be good. Congratulations on saving a bunch of money for a system with a bunch of so-so and some nice resorts.

I recommend going to the New to Timeshare forum here on TUG and let us know what you want to spend and where you want to travel, and we can recommend a resale that will cost pennies in comparison to what you were paying for the BG.

Welcome to TUG. We love timeshare here. We just like to buy resale whenever we can. I know people who paid developer on purpose, knowing full well about the resale market, and I understand their decision to do that. I have been guilty of that myself, years ago, but you lucked out.

No need to worry about delivery as long as you retained US Postal Service Postmarked proof that you mailed it within the required time frame. It is the specific Postmark date that counts, and not when they actually receive it.

I am led to believe that Bluegreen actually has a Post Office Box and only pick up their mail once a week or so. With that said, it will sit there until they go in and pick it up.

I assume that you mailed this with a tracking number so that you will be able to track the actual scanning activity for yourself. Your tracking number should indicate the "date of acceptance" which is the same as the Postmarked date.

Welcome to TUG. Sorry to hear that your first contact with Bluegreen left a sour taste.
Every VOI (Vacation Ownership Interest)/timeshare developer wants to make a sale, because that's how they make money.

For many folks, a VOI ownership works for their family; for many, it doesn't.

There are any number of ways to enjoy the advantages of timeshare without the commitment of timeshare direct ownership, including renting from folks on this website who own timeshares but for whatever reason cannot use their assigned time slot.

We were pressured into buying at the Fountains last weekend, but are within the rescission period and will be sending in our rescission letter tomorrow, by certified mail, return receipt requested. They gave us a tote bag with materials at closing: owners' guides, the charter document and free RCI week certificates (I'm sure they will cancel the charter and RCI certificates). Do I need to send the bag and guides back also, since there was no mention of returning them if rescinded? Has anyone had them charge for materials not returned?

Just send them back to them via the cheapest Postal rate available and be done with them once and for all.
