Can I buy a new AT&T cellphone without signing a new Cingular contract?

While in Hawaii my husband went swiming with his cellphone in his pocket. So now we need a new phone. We have a family plan with AT&T that I like very much. Cingular has brought-out AT&T and they told us that we can't simply buy a phone from them and make it work with our current plan even though they now own AT&T.

Does anybody have any ideas or knowledge about this, or any suggestions on what I can do? I know that a lawsuit has been filed against Cingular alleging that they are forcing former AT&T customers to sign new contracts. I don't want to get ripped off.
 
Have you checked out the plans that Cingular has available? I have been a Cingular customer for over 5 years and have been very satisfied with their service.

My son broke his AT&T phone and I got another from Ebay. The only thing I had to do was put his sim card in the new one and it worked fine. Hope your sim card is still good!
 
What's so bad about signing a new contract? I had an ATT Nationwide Plan for years. I went through the same thing when my phone went bad. Cingular gave me a highly discounted phone and a similar Nationwide plan with more minutes and a lower monthly cost but I did have to sign a new 2 year contract. I have no regrets.

We went through the same thing last year when my daughter spilled coffee on her cell phone. We actually had a better plan with the old AT&T and didn't want to switch to Cingular; the Cingular weekend/evening hours start at 9 p.m., while the old AT&T plan, they started at 7 p.m. We checked with Cingular and they would only give a deal on a phone if we'd sign a new contract with them. My husband found an independent dealer/repairer who sold us a refurbished phone; I think the dealer had to get a new sim card, but had the connections to get that and and get it switched to the correct number. We found the dealer online, I think, by searching for companies who could provide service for Nokia phones.

Recently, we had to switch to Cingular when the AT&T contract expired. We got 3 Razrs for $60 each; however, about a week later, my husband washed his Razr in the pocket of his jeans and no more Razr! He got the same guy to put the sim card from the Razr into one of our old phones. Too bad. We may look for a deal for a new phone on Ebay sometime, but don't want to pay $250for a new Razr. At least we have 2 other old phones he can use up if this one goes bad.

We also checked into using our cell phones when in Europe and it sounds awfully expensive through Cingular!

Used All The Way.

We get our cell phones from eBay & Craig's List -- used all the way.

Our cell phone service provider is Sprint PCS. We just call'm up & follow the steps the tekkie on the other end tells us & then -- WHAP -- our existing plan & our old established cell phone number & all that are instantly switched over to our latest eBay or Craig's List cell phone.

Then again, we get practically everything used except toothbrushes & underwear.

Well, sure.

But it was only once, just 1 time -- singular that is (a toothbrush, just 1), not plural (toothbrushes). And besides, that's another story.

Not only that, when I was at Wal*Mart in Rehoboth Beach DE earlier this week, I bought a brand-new, unopened pack of pristine, untouched Fruit Of The Loom all-cotton tax-free skivvies. (The Chief Of Staff helped me pick'm out. Not that there's anything wrong with that.)

(No retail sales tax in Delaware. If you can't -- or won't -- buy used, you can still buy tax-free.)
