One week after buying a timeshare I learned I had a pretty whopping tumor which required immediate treatment. I called Wyndham Sedona where I had purchased and asked to cancel the timeshare purchase. The sales manager was quite vague and told me she didn't know how to do that but I should talk to the salesperson who sold me the timeshare. When I spoke to him, all he wanted to share was that he had a mass in his liver. I have tried contacting other parts of Wyndham, but still have not received a real answer, only an acknowledgement email saying they had a high volume of emails to respond to.
I had surgery 12/30 and will have another next week. Then chemo and radiation. Naturally, not much time to work and earn money to pay for things like timeshares. I hope I can make my house and health insurance payments!
If this is how they respond, what a sorry mess they are. Why would I want to stay at their timeshares when they are so unresponsive?

Not to be mean, but they don't have any obligation in refunding your money once you got out of the grace period. Try to rent it out to a friend/neighbor.

I'm so sorry about your health problem. Good luck with your treatment.

Each state has a rescission period during which you can rescind and get all your money back. It's usually from 5 - 10 days, depending on the state. The rescinding Info. should have been in your purchase papers. No one ever has any luck rescinding after that time frame. Right now, many people are hurting in this economy and want to get rid of their timeshares, so the timeshare sellers may be especially callus right now.

Here is an article about Rescinding, for more info. It was written for another system, but most of it applies to all timeshares.

Try to write them a letter, explain your situation, attach your Dr.'s letter, ask them to void your contract.

Since you have pass the grace period, they don't have to void your contract. I do read people in distress get out successful.

I think it is important to figure out when you called the sales manager about rescinding. If you were within your rescind period, and he simply tried to "stall" you by being vague, etc, and deliberately trying to push you off until the rescind period expired, then I think depending on the state, etc you may have some recourse. Obviously an attorney would know exactly if you did.

Definitely looks like a "canned" response to me...

I don't know if you are up to playing hard-ball, but my next step would be to send them a registered letter, with a letter from your doctor, stating that since you were denied your legal right to rescind during the rescission period, you are rescinding now.

Make it short and clear, and make sure you state the date and time you called about rescinding and the name of the person who refused to give you the info.

Then challenge it with your credit card in writing and send them a copy of everything.

I would also contact the state Attorney Generals office with all the details. The Washington State consumer protection division of the Attorney Generals Office has been very helpful for me in cases where I was getting nowhere with the problem company.

I am SO sorry for the health problems you are experiencing. That has to be quite a burden at this time.
