I think a smart
buyer should
always insist upon selecting and using (and paying for) his/her own independent closing company to handle all of the estoppel, deed preparation and recording and escrow issues for the entire transaction.
Yes, it's an expense of a few hundred dollars, but in my opinion it's money well spent to ensure that all details are handled correctly, honestly ---
and fulfilling all applicable state legal requirements. Needless to say, in this instance the closing company should be one based in (or at least well experienced with timeshares in) Hawaii, since I'm told there are some "unique" issues and details (and fees) there.
