I Like The Rest Of The People In This Forum Are New To The Timeshare Game. I Need Some Help In Deciding If My Purchase I Am Making Is A Sound One. I Am In Day 2 Of An Offer I Made At The Westin Maui. It Is A 1 Bedroom Ocean View. The Negotiated Price With The Seller Is $16,500 For Every Year. Can Someone With Knowledge Let Me Know If This Is A Decent Deal Before My 7 Days Runs Out.

Welcome to TUG! I couldn't tell from your post, but if you bought from the developer, you can do much better on the resale market.

Let me give you an example - I bought a 2 bdm. at the WKORV before it opened, and now it is selling on the resale market for 66% of what I paid.

Based on what you've said above, I'm assuming you're negotiating with a private seller and not the developer. Is that correct?

Based on the prices at the main resale sites I've seen, $16,500 seems reasonable.

Do you mean the Westin Ka'anapali Ocean Resort Villa (WKORV)? and not Westin Maui? (I thought the Westin Maui was only a hotel...) If it is WKORV, then $16.5K for an EY 1Bd WKORV resale is a very good deal - they have been running $17K+. What do you mean before your 7-days run out? Is this resale thru an individual or broker? It can't be SVO (Starwood) selling at this price...

No matter - just make sure you know what you are buying and complete details - make sure you only deal with money thru a known Title Company - do not send any individual money - even a good faith deposit. The Title Company will get an Estoppel Letter, check the Deed/Title, transfer the Deed/Title, and ESCROW (funds)

Those laws do not apply to private purchases - that's why I wasn't sure if you were buying from the developer or not.

The view you get (within your deeded category) is based on how early you make your reservation and the earliest an owner can make a reservation is exactly 12 mos. out at 9 a.m. EST. Since you are past that date, I would ask the present owner to make a Resv. for you immediately, as part of the deal. He can put the confirmation in your name and send it to you or have Starwood send it to you. After 8 mos. out, owners from other resorts can exchange in, and you will be competing with them for view priority, and you lose your owner's priority, so you don't want to wait until the deed is in your name.

Actually this varies state to state. The 10 day recision period in FL applies to private purchases as well, can't speak to HI in this area.

Thanks Denise. It is our first timeshare purchase. I have been studying the TUG postings for a couple of months. Hopefully it works out for us. For my next purchase I need to figure out how we can get away for some long weekends in Southern California, Mammoth and Tahoe. I probably need a good points program or a points based RCI purchase with a low maintenance fee. If anyone has some suggestions, please let me know. Thanks for all the help.

This is only kind of true.

In Florida, the 10 day period must be writen into all contracts to buy timeshares (both developer and private sales). If there is no clause in the contract, Florida law gives you have 1 year to rescind. :doh:

That's correct, it applies the same to developer and private sales. The point I was making that it DID apply to resale as well as retail for FL. Since I don't know about HI, I was raising the question that it might there as well. I think the only other state I've actually looked at in the past was Oregon and I seem to recall their laws were similar to Florida's.

Ditto to what Densie says. We own a 1-bedroom purchased resale, paid about $3000 more than you did and thought that we got a good deal. So it sounds like you have a very good deal.

The term there is 7 days and it appears at first glance that this likely applies to all sales including private sales mainly because I couldn't find any wording that either restricted it to developer sales OR that excluded private sales. Given the nature of vacations to HI and the travel time and timing back to the mainland, this could be very restrictive for many for a developer purchase. The good news was it seemed to override any additional restrictions a developer might list as mailing to the address specified within the allotted time appeared sufficient. Of course doing it in a way that documents that you met that requirement would be advisable.

We used the 7-day right to cancel a developer purchase at WKORV-N this August...we toured/bought on a Wed, and cancelled via fax that Sunday after we arrived home.

As long as people don't tour/buy very early in their visit, they should have plenty of time to back out once they realize the developer purchase is a bad idea for them.

We found that cancelling while we were there (surrounded by all the amenities) was not as easy as when we got home, ran some numbers and realized it was a $ sink hole... :)
