Westin Aventuras rescinded next day

So, got suckered into signing Westin Aventuras after not doing any research. Yes, I know, stupid. I immediately went the next morning with a signed letter stating that I was rescinding. They signed my letter and gave me a copy acknowledging receipt. Now, I’m just worried about my deposit and wondering if I should file a dispute with my credit card company. I know I have five business days to rescind and it’s only been 4 days since the initial signing. Also, after scouring, these forums, I’m a little worried the sales people might not be on the up-and-up and can possibly deny ever receiving my rescinded letter. Thought? Thank you to all of you that helped me not be stuck forever!

Did your contract provide a provision for rescinding in person? It is always advised to rescind by following the letter of the contract. That said, you should be good, but you still have a day. Can you still mail a letter? There is no need to dispute anything with your credit card company for a legally rescinded contract. Vistana is an honest company (for the most part) and follow the law when required to do so. Even the worst of the timeshare companies don't play games with rescission.

Thank you for your reply. Yes, contract stated that I could rescind by returning in person to the resort where the contract was signed. Furthermore, they gave me a copy of my rescinded letter acknowledging receipt. They took back all documents so I no longer am able to mail anything as I no longer have the mailing address nor their email address. It’s just that after reading through the forums…it has me more than a bit panicked.

Then you should be fine. A tip if there is ever a next time. Don't give them any paperwork back. They are not entitled to your copies to be returned to them. They have their own copies of that stuff.

It can take them a while to process your rescission and refund your card. Expect the charge to actually post to your credit card and be refunded later. It can take up to 45 days.

Ah, see now that worries me more. They said needed everything back. Truly hoping I’m not screwed. Thank you!

If you have a signed receipt from them that you rescinded, treat that like gold.
