Westgate timeshare recission

I'm vacationing at a Westgate resort and am still on site. Two days ago I purchased and didn't receive copies of the contract, which will be sent on cd. I would appreciate any advice on rescinding. Should I try to get a hard copy of the contract, or does anyone have specifics on rescinding a Florida Westgate timeshare?

Yes since your rescission rights will have expired before you receive and read the CD
 
Thats a slick tactic, not giving you a hardcopy on the spot.
 
The only thing you should need would be the address to send your rescission letter to- it's unlikely to be the sales office where you bought. Perhaps some other Wastegate owner has it in their contract?

Then just a letter saying in effect, I/we wish to cancel contract #xxxxx.xxx dated 1/xx/2012 as allowed by law. Please return any deposit paid and cancel any credit card transactions. Any prizes awarded or favors given will be returned to Westgate at the place requested, upon receipt of our down payment.

Do whatever you have to to get that address and send that rescind letter NOW!! If you don't you will regret a Wastegate purchase forever. There are some great deals in timeshare but they are all resale and never Wastegate resale or retail. GET OUT NOW!

is that not against the law?? how the h$ll can they not give you a signed contract on the spot. They could change stuff and you will never know till it too late. I see a class action lawsuit coming..

all i can say is WOW... that is low for even wastegate.. :doh:

jturpin you might want to contact the Florida attorneys generals office and let them know what is going on as well.. this has to be against the law in some form.. dam... :eek:

Last year we were there - at Westgate - and did the tour. I must admit, it took my breath away! Never had I seen so high a price for one week. My wife and I did an estimate, before we got the actual numbers, and the real price came in more than double the high end of our range. I almost choked when they told me $42,000 for one week!

And when you find out that very same "$42,000" use can be easily obtained for $1 or someone may even pay you to take them off the deed and get out of a typical Wastegate nightmare that choked up feeling becomes a full gg and you rightfully want to do very bad things to those that sold you the seemingly beautiful property. Why is it only the Wastegate models have have that "pop" that makes you want to be in the unit? The actual, assigned to owners guest units are somehow beat up, cheap looking and never up to that standard. Just SOP or Wastegate (and too many other developer controlled resorts).

While virtually all of the retail ts industry is slimy as best and outright crooks like Wastegate at worst, Wastegate does have it down like no one else when it comes to pressure and sleazy operations and sales.

Let's hope the OP did find that address and got out when they could and before they felt that horrible pain in their wallet.
 
I'm currently fighting with westgate over lies they told me at the Smokey Mountain location. I was told by paying cash I would be grandfathered in for value season which was changing from weeks 1-4, 9-12, 44-46, and 48-50 to only weeks 1-4, and 9-12. Now they insist that it was only for the free rewards week. I asked again and again to be sure I would have weeks in November and was told I did. They have a cover page that shows value weeks in yellow and all weeks in red with the exception of an amber color for weeks 44-46, and 48-50 which is misleading showing that that is the old value season that I would be grandfathered in. Also on rewards week contract letter it states "this certificate entitles you to stay at any westgate reort during "value season". They claim this "value season" wasonly for free week. The only reason I bought was to use in November.
I bought on top of mountain in the 3000 and 4000 units which are quite nice but They lie!!!!!!!!!!!!!!!!!!!!!!

Found my contract

As a point of clarification, before I left the resort, I asked for a copy of the contract. I had received one, which was inside the briefcase in an inner, velcro secured pocket. I didn't immediately notice it until I asked for a copy and the closing agent pointed it out to me.

I'm preparing to send the recission letter tomorrow. I will follow up with the results.
 
Someone is giving away a Westgate 4BR lockout with 2012 MFs already paid in the marketplace. Jump on that one and splurge buy your wife a humongous diamond with all the dough you just saved.

Excellent news. Travel home safely. Get the rescission in the mail exactly as their instructions say, then relax.

If you still have a taste for time share, c'mon back. read up on what it's about. What the benefits are, and perhaps as important, what the costs- both open and hidden- are.

There is always time to buy, but not always time to decide if buying is a wise decision.

As an update to others - I received a call from the manager at the Westgate resort. They received my cancellation letter and are processing it. The manager did want to know if there was anything they could do, and cordially asked if they could make a better deal, or if anything happened.

I politely replied that it wasn't in my best financial interest, and we concluded the call in a polite and friendly manner.

All of the information necessary to complete the cancellation was in the briefcase, and the important contact information can be found on the first page of the contract. At this point, I assume the process will proceed as required by law.

where did you find the info, I have a hard copy & a disk & there is nothing in the hard copy to cancel, unlucky for me I have a macbook air..no cd drive, so not sure if its on that, we are vacationing for 12 more days so by the time we get home its too late, need help to find out exactly how to cancel, some says it has to be served as indicated in the contract

Go immediately to your closest store offering computer access & read the directions off that cd. They DO hide it on there & you DO NOT want to wait- you want to get the address TODAY & get the rescind letter correctly mailed & on it's way.

The local FedEx or UPS store may offer cheap access. Your hotel/resort might offer it in a business center as well. Once you read / print out that section follow the steps exactly with a letter as simple as:

We hereby terminate agreement #XXXXX dated 3/X/13 per Florida state law. All payments made are to be refunded and no future payments due or payable. Be sure all original signers also sign the rescind letter. It does NOT have to be notarized. But do pay attention to the proper mailing procedure as that establishes the date & proper cancellation notice.

Something like that. Simple - you want out and mailed correctly. By law they must cancel it if you follow the rules.

The "results" are a foregone conclusion and are absolutely guaranteed to you by applicable state law. As long as you submit your contract rescission in writing, within deadline, and to the location specified by the precise means identified in your cancellation instructions, your cancellation must be honored.
The slimy sales weasels quite simply have no choice or option; it's the law!

Also, please do not make (...or take) any phone calls on this matter. Phone conversation is just meaningless noise in regard to the contract and any unnecessary phone conversation may only muddy up or delay processing of your written cancellation request.

I have found the info...we were tricked saying to sign here & we'll give you all the documents on CD...well what you are signing is that you acknowledge you have access to read the cd before your 10 days is up & that is in fact the ONLY document on there!!!!!! I will post the entire thing with info for others when I arrive home, hate for someone else to be fooled by them!!! by the way we already owned & signed 3 sets of documents as we kept finding things they were tricking us on...guess we missed this & it was NOT explained to us !!! very mad & sad there is individuals that can sleep at night after lying & basically stealing :(

Just feel good that you discovered this before your rescission period was over. As long as you properly rescind, you'll have the contract cancelled and get your money back, so you can enjoy the rest of your vacation. Once you get back, just spend time on TUG researching the best way to accommodate and maximize your vacation "needs". And then do back flips once you find out how much more economical you can do so by renting timeshares from other owners or purchasing a timeshare on the resale market.
