Walking Away From Raintree Maintenence Fee's

How is an owner contract enforced regarding MF's if a contract never existed? The only signed document I have that might exist is a transfer request. (RTU and I bought resale on eBay) I am considering walking away if their is no such contract. I've read about the intense collection calls, etc...Most harrassment calls/letters can be legally stopped. I've read about dings on credit reports. If you reseach FICO forums, a collection agency can not report on you if they can not prove you are legally obligated to that debt, ie; MF's. If the CA's have no paperwork, this can not be reported and very easily disputed and removed from all reporting credit bureaus. It is a fairly easy process to challenge any collection agency if this were to happen. Has anyone had any experience with refusing to pay MF's and actual credit bureau reporting on a resale from eBay?

You submitted a transfer request, which presumably was processed to transfer ownership of the unit. As the succeeding owner you assumed all of the obligations of the prior owner. That is what transfer of ownership is all about.

You have no contract with Raintree because your prior transaction was with the prior owner, not with Raintree. That does not negate the fact that you assumed ownership.

An analogous situation would be if you were to buy a condominium from a previous owner. The condominium owners association is not party to the sales contract. But when you acquire ownership you would also acquire the obligation to pay association fees and assessments. The fact that you do not have a contract with the condominium owners association is irrelevant.
