I own a two bedroom lock off in Harborside Atlantis the yearly maintenance fees have become ridiculous and I want to get rid of it. I called Vistana They said they do not offer any deed back programs. Can I just stop paying the maintenance fees and have them take it back? Are there legal fees involved with this? Does it affect your credit?

If it is a prime season, then you might be able to give it away for free. Have you tried this yet? You can certainly stop paying and it will go to default and at some point they will foreclose. If it is paid in full, chances of an impact on your credit is low. But there is always that risk. What is more important, getting rid of the timeshare or the chance of a couple hundred point credit hit. Do you plan to take out new credit in the near future? If not, a credit hit isn't all that bad of a thing. It tends to repair itself fairly quickly. Though you may have some increased costs for things such as insurance.

1. Do you own the timeshare outright or do you have a loan?
2. If you own it, you may be able to sell it or at least give it away.
3. What season? This will impact the desirability of those interested.
