Vidanta purchase SCAM from my presentation. Potential Buyers Beware

We went to Nuevo Vallarta at the SPA suites in tower 4 last week 10/10 - 17/2020. Beautiful place hands down. We took the bait to go to the presentation. In a nutshell the offer was buy our timeshare points from Holiday inn club for $212,000. We were guaranteed $5500 a year for entire 100 year member contract under the ambassador program by the sales agent. Then we have 2 Sea Garden weeks that if not used & turned over to Vidanta for their marketing practices we are to get $3600 each. $7200.00 annually for the 100 year contract. That is a total of $12,700 US dollars annually. We bought a Grand Luxxe Deluxxe 1 bdrm for $54,000. Our current cost for MF is $4,100 annually for Holiday Inn Club. The pitch was the $7200 would cover the cost of the usage fees and the monthly payments to cover the $54,000 for the unit. That would eliminate our current MF to Holiday Inn Vacation Club. We told them we would not be able to afford it and was backing out. The manager (You know the drill) came in and said they would pay the first 2 years of the four weeks of Sea Garden that was promised for the 100 yr membership in advance & take if off the sales price. That was $14,400 US dollars. We figured that to be a good deal. Which it was. So we went through the purchase exercise. The next morning I started reading over the contracts and discovered there was nothing about the $14,400 in the contract pricing or anywhere. I did not see in the contract about the Sea Garden buy back annually and to the end of the contract term. My Brother-in-Law an I who are co-owners went to the sales office and requested the deal be halted & we wanted out. We asked is there a back out time frame. We were told yes 30 days by our sales person. Our sales person then asked why are we backing out. I gave him the details about the $14,400 and there is no trace of it in the sale documentation or figures in the contract. He stated that he would get us a document of the transaction and state what the $14,400 dollars was for. He produced a document. And I have that documentation. We decided to stay in the deal.

Got home the next week and started looking into the Ambassador program and what was needed to get this to a charity so that we can get the $5500. Lo and behold #6 for the enrollment application it states that VRM reserves the right to modify or discontinue the program at anytime. Well there goes the $5500 annually for the life of membership agreement promised. And we were told as long as a charity signed the certificate and we submitted that is was donated. We would be credited. The documents states the user of the cert. must stay at the property before credit is given. ( Out right lie). I contacted the Vidanta and got confirmation that is the process. Ears on alert I asked about the $7200 annually for the Sea Garden 2 weeks. Was informed that Vidanta does not pay for any weeks not used and I have the right to pay the usage fee to use the weeks.
Flabbergasted! I have been had. I asked about the 30 days out clause and I want to take it. I was told it is documented in one of the contracts. Well the contract says 5 days. Lied to again.
Just to be clear I am currently out of $18,000 deposit into the contract membership. It states I have 5 days afterwhich if out is chosen there will be no money reimbursed. Now, Legally I would say they may have me. except I have the receipt signed and printed out by Vidanta given to us after contract signing. I will be legally fight for my deposit. Not sure of the outcome.

I am hoping that this post helps someone that will be promised all of these lies and they exercise their out clause if duped by these sales lies.
You will find it hard put to get 10 certificates to actually use them and you will never get paid by Vidanta for weeks used for marketing.
Also - In the final contract sales meeting you will be asked has any promises been made that is not in the contract. One would think with the sales person there and everything you been promised is in the contract that the answer would be yes. Obviously not true!
Advice !!! Ask if any of the dollars promised to you in the future is listed in the contract and is it legit.

Call the VLO - the person who gave you all the documents. You still may be able to get out o this and your deposit back. Do not call Sales. Customer Service and the VLO are the ones that can help you get out of it.

BTW - you still own the HI. You will have to pay someone to sell it or you.

What is the VLO? Purchased a package at Vidanta Riviera Maya today. It is for 5 years and has a clause about keeping our deposit if we cancel. We paid the entire amount up front ($4,000). I asked about rescission and was told I would lose the entire amount. Purchased mainly for the cruises but it looks like there are more fees for the cruises then they mentioned. They mentioned we would only pay port fees but there are also activation fees. Not sure it is worth it. How can we cancel? We are still here until Tuesday.

VLO is a made up term from the mid 1980's and stands for VERIFICATION LOAN OFFICER. Its the man of woman in the office that went over your contracts with you who told you they were not part of the sale team. The people who are VLO are the resort people who are smart and well versed but could not cut it in sales. Usually its a son or brother or girlfriend of top management. In Cancun back in the 80's, the term was coined and caught on because it SOUNDED OFFICIAL and people buying felt as if it was an actual REAL ESTATE CLOSING. It cut down on people canceling. These people are not any more official than your sales person was and they are in on the deal.

You are given a three day (or maybe five... I cant remember) right of recision by LAW even in Mexico. In some places the VLO and sales offer you a waiver of this right, but that is not legal.

Any time a timeshare resort is offering to PURCHASE a timeshare you already own, they are just moving around the dollars on paper, where you will STILL OWN your timeshare but it will be too late for you to do anything about it. Charities do not want your timeshare. That is baloney that you can sign it over to a charity. Millions of people would have done that if it were true. Its not true. Just like all those companies who tell you they can legally get you out of your contract are not for real. Or that they have buyers for your week if you LIST it with them for a fee.

I dont know what you can DO to get out of your Vidanta week since you are definitely past your recision period. You own it. Might as well use it and enjoy Vidanta... which is one of the strongest developers in the world financially and has some of the nicest resorts you could ever want for. There were worse places you could be stuck owning. You liked it enough to buy it, so love it and vacation there.

If you want to stop falling prey to sales tactics, stop taking TOURS. All of you... STOP. The breakfast is not really breakfast and NOTHING is worth losing a day of your vacation unless you truly would love to know about owning at the resort where you are vacationing. These sales teams are PROFESSIONALS and before you know it, you are signing documents. IF you are not strong enough to say no to taking a tour, 1 of every 3 of you will end up buying.

You are 100% correct in today's world but 15-20 years ago I successfully gave 7 or 8 low value Weeks to charities. Most would tell me how much they sold them for to document my tax deduction....

The bottom line is always the price listed in the contract. How they got there is pure bull..... All the rest is just financial manipulations to make you think you are getting a deal. When we returned to rescind our deal, Vidanta offered to buy back the 2 residence weeks in the first two years for $14,000. They did reduce our cost by $14,000 (in writing) and we still used all 4 weeks that we supposedly sold to them.

The ambassador certificates are just a way for you to allow non-members to vacation at Vidanta. They still pay the normal usage fee plus an extra fee. If that person actually uses the ambassador certificate then you get something like $300. You are essentially providing fresh meat to the Vidanta sales team.
