UPDATE: Rescission Period??

UPDATE: I didn't find anything in the folder but, I did find all the contradictory information in the Purchase Agreement. I sent the following letter today, overnight USPS. Today was day 5. I think I covered all of my bases. Thank you for everyone's feedback! (Florida vs NV, Seller's address at the top of the contract vs the name and address in the cancellation paragraph! phew!)

Luckily I paid in full with my Chase CC. So, if they give me a hard time, I have documented everything and have proof of cancellation and can dispute the charge. Wow!! All I can say is Thank you!!

I will now go learn how to purchase the best property for trade, I love the idea, I hate the racket.

Hi I just purchased a timeshare unit from Westgate. I keep seeing a rescission periods listed in the forum but, I don't remember being notified of the right to cancel. Any insight? I purchased during a presentation in Las Vegas but, the resort I bought was in Florida, Westgate Blue Tree.

Westgate does a good job of hiding the rescission information. Chances are they gave you all of your documents on a CD or thumb drive? If they gave you a binder with printed documents, look for a hidden pocket. You will find the rescission information if you look hard enough. Nevada has a five day rescission period, but I think you may also be covered under Florida's 10 day rescission since the property you purchased is located there.

Congrats on researching and rescinding. Your documents will tell you how many days to rescind along with instructions. That hidden pocket should be in the binder area. The fact that they put your documents out of sight is likely intentional, hoping you don’t find it until after the rescission period. While I hear the resorts are nice their sales tactics are among the industry’s worst. In addition, they put severe restrictions on resale buyers in order to preserve their retail sales efforts despite the fact that this hurts every single retail buyer in the long run. In part due to the restrictions, your thousands of dollars paid retail is the same as if you flushed it down the toilet because many Westgate resale timeshares have a negative value. This means that you would have to pay off your retail loan and then pay someone just to take the week off your hands.

Yes, it was all on a CD but, had a printed copy of the Warranty Deed and Purchase Agreement too.

Congrats on getting that rescission letter in the mail! Whatever you do going forward, steer WAAAY clear of (as they are known here: Wastegate! They have nice resorts but absolutely abysmal and predatory business practices regarding their 'owners'. Run away as soon as their refund hits your card.

I would stay away from Westgate. Even when you buy resale, they will pressure you to do update presentations. There are so many other timeshares to chose, take your time and find one that suits your needs not theirs. Good Luck!

Then the Purchase Agreement should include that. You need to get access to the CD or you can try sending a letter to Westgate. I know the address has been posted here before;


Edit: Didn't see that you had updated your initial post. Leaving the above here in the event someone else who signed with Westgate comes across this thread.
