unemployed usmc vet can't get out of timeshare cause 1 technicality: third party purchase

i got mine off ebay as well for a decent price early 2014. haven't used it in about 5 years. wit covid and lost job things are maad tight. diamond resorts is with hilton grand vacations, who has a transitions program that helps get out of ownership. i have checkmarks for doing that program except 1: that i bought the timeshare thru a third party. this doesn't make sense to keep me liable even though i have the deed, make all my payments and willing to give back to them. i'm thinking of stopping my payments also. this is very bad for me since i'm a budget, with no job, a veteran dealing with mental issues ptsd from the usmc. this is sooooo frustrating

This forum is for HGVC deeds but there is also a Diamond/HVC forum so the mod, @GT75 can move it there so that you get responses from other Diamond owners versus HGVC folks who have different rules. Hope that they are able to give you some good advice.

Thank you for your service. That’s a terrible situation, especially over a technicality like buying resale. I’d keep escalating it with HGV and ask for a hardship exception. Hopefully someone there can step in and do the right thing.

Your situation of HVC not allowing resale purchasers to return the unit is exactly why former Diamond units are worth zilch. Stupid rule.

With that said, there may be someone out there who wants this unit because they own there and want more. So start by trying to give it away on the TUG Free Timeshare giveaway. However if you are behind in payments you cannot give it away.

Do you owe only maintenance fees? i.e. you don't have a mortgage? If so the odds are in your favor. Only 1 in 7 had a credit drop with MF only: Of course YMMV.

If your unit is a deed in Florida (I see this on your profile: Grand Beach Orlando Florida 3-Bedroom Plat even. You may walk away, stop paying and default if you do not respond, do not pay and do not give any indication that you object to the foreclosure of the unit. Florida will put the deed nto foreclosure and HVC gets the unit back as "compensation" details below. They cannot go after other assets even though debt collectors may say otherwise to bully you into paying. It may take 2 - 3 years and bill collectors will harass you, however you can cite a US law to only be contacted by mail and then ignore the mail.

Do not may Chuck McDowell or any 3rd party to "get you out of your timeshare." Those only do what I have told you above and you pay good money when you can do this yourself.

Try going up the chain to make your request as a veteran and in financial hardship. However, there are fees associated with transitions. Please be aware of that. Contact Leigh.nieman@hgv.com.
