After several years of going to Kauai we have decided to gift our Shearwater unit to our daughter. In the past I have used a quick claim deed in Florida to transfer a unit to my brother. Does anyone know if I can use this method in Kauai? I called the Kauai courthouse and the employee was not helpful repeatedly stating "We do not offer legal advice and you need to retain a lawyer". The unit is all paid off and I don't think I need a lawyer to just transfer it to my daughter. We will be on island in December and thought I could handle this myself. Any suggestions? TIA

Did you convert this deed to Wyndham points, and does she want the points? This is very important that you keep your name on the deed as well as her name. So you type a deed and just add her name with yours, then she has use of the points.

Quitclaim deed is not the only way to do this, and you don't want to give your daughter a quitclaim deed.

You should type the deed yourself, copy it word for word, every punctuation mark must be correct, do not leave off colons, semi-colons, dashes etc., and call the county and ask how much to record the deed, but type is as a warranty deed because it's paid off. This is not hard to do. I have Rick read me every word, so I am not looking back and forth at a piece of paper. You have to leave space at the top for recording (stamps, etc) and indicate where the deed should be sent back to, which should be you, and that you prepared the deed, so the top lefthand side should say:

Prepared by and return to:
John Smith
100 Main St
Anytown, USA 10000

Your daughter doesn't need to sign documents, only you should get the notarized signatures.

If you don't want to do the "deed" yourself, pun intended, you can have LT Timeshares do it for about $300. No money exchanging hands, so it's an easy process for them to get that recorded and won't take time. Wyndham will take up to six months. Crazy. LT Timeshares is readylegal@gmail.com

Reach out to Hawaii Document Service. BTW - the court has nothing to do with recording deeds.
