An alternative possibility is that the seller wanted a higher price for the unit and never submitted it to Marriott for ROFR.
I don't think that happened. As I mentioned upthread, Marriott contacted me directly and said it had exercised ROFR over the purchase I was tentatively going to make with the Ebay seller. I think it would have been too much effort for the Ebay seller to impersonate Marriott, and beside the putative Marriott rep who called me to say it had exercised ROFR then started telling me about bundles it had available, offering me details about points plus legacy weeks bundles it had for me. The Marriott rep also know the exact amount of points I'd need to climb up in status level, something I didn't disclose to the Ebay seller!
