No real surprise here, with Westgate having already consistently lost this case in multiple lower courts and associated appeals.

An interesting development may be yet to come. I have to wonder if SeaGull is just arrogant enough to defy the courts and refuse to pony up the half-million dollars. :ponder:

Hopefully this shows other developers stubbornness will get you nowhere. They think with all that money and power they have accumulated they are above the law.

It is hilarious because I had a similar something with a developer that was heading to court if they had not gone above and beyond to handle my situation.

Upon doing some digging I learned that there was a specific someone that was assigned specifically for attorney general claims out of that office to handle this resort bc of the amount of claims they got a month. I talked to this man on the phone and he stated not one claim he had ever seen come in did the resort not settle.

It was like it was part of their business model to know and understand some people were going to call shenanigans and if we don't let them have their way we chance the AGs office shutting us down from facilitating more sales in the state.

Did they honestly think the SCOTUS would hear this rubbish claim?

This is more a product of their poor customer service than anything else.

They deserve this and the thousands of cases that follow. Until they change their modus operandi, and stop treating customers like potential targets this will never change.

I think they thought that they had enough friends in high places that they could get the members of the high court on the right to agree to hear their case. This certainly isn't a case that is worth the courts time.
