Selling: who pays what?

I know I have read that "most" buyers pay the closing costs, but what about already paid maintenance fees? I have paid our 2006 fees on the unit I want to sell, so wouldn't the buyer have to pay those back to me if they want to use the 2006 week. Or, if he doesn't pay them, then I still get to use the week??? Need some help here, please.

Everything's negotiable and should be put in the contract.
Just because the buyer doesn't pay the current year's MFs doesn't mean you get the use unless you spell it out in the contract.

That's the key.

When you compose your ad, decide what you want. For example, you could state, "Buyer's first use will be in 2007, but use in 2006 is negotiable."

Hi:

I have sold quite a few weeks at Internet auction.

When we run into this situation the seller usually wants to be paid the fees back.

Full simple disclosure in the terms of sale about the fees will help quite a bit.

Collecting pre-paid MF's for off time or less popular resorts will usually have a negative impact on the bid price, especially if you are using eBay.

On the other hand we collected pre-paid MF's for Marriott Desert Shadows and a Williamsburg Manor unit weeks in addition to pleasantly high auction prices.

Everything is negotiable.

Be clear in your disclosures!

When you are advertising this year everyhting is paid for and ready to use, if its a nice place and good time you may just get a higher price.
