Hello,

I have a 2 Bdrm, 7,000 Point Every Even Year and I own in Sea World in Orlando Florida.
I have come into financial hardship. I can't sell because I still owe.

What are my options?

I been reading threads and seen people take action by not paying. I contacted Hilton and don't get much support. I'm waiting for the Hardship Department to call me back.

See what the hardship department says.

If they don't offer a buy-back you are in luck because your property is in Florida which is a "non-judicial, anti-deficiency state". Tell them you are willing to give them a deed in lieu of foreclosure because you know that Florida is a "non-judicial, anti-deficiency state" so the best they can do is ding your credit record, send you a lot of nasty calls and letters but all they get in the end is to take back the timeshare. You are willing to help them avoid this cost by offering deed in lieu. Search TUG for the term "non-judicial, anti-deficiency" for details.

Do people have much luck with selling their timeshare here?

Yes if it is priced right and is a desirable property. I don't think yours is worth more than $2,500 net. So probably not enough to cover your mortgage if you paid it off in order to sell it. Better economics to walk unless you care about your credit rating, but if it will be trashed anyway because of financial hardship, you are not losing anything.

BTW...we are not lawyers so YMMV.

I have MF due Mid Jan. If I stop making payments and not pay my MF will by reservation be
honored?

Question 2:
Can I just give it away let someone take over payments?

Question 1: You said you have hardship...and you want to spend money to visit Hawaii??????? ...if you don't pay your MF I wouldn't count on the reservation being honored.

Question 2: Why would someone take over your payments if they can buy the same property for almost free?

How much do you currently owe?

If I was selling a 2015 Fusion that was worth $13,000 and I owed $13,000 then someone might find it appealing to just assume the payments. If that same Fusion was worth $5,000 then no one would want to assume the $13,000 loan. Timeshares are going to work on the same principal. I agree with CalGal in that your EOY 7,000 points is worth about $2,500. That isn’t even considering the broker fee if you had an agent sell it for you.

As a general rule around here, you shouldn’t ask permission to skirt the system. It always turns out bad. I once asked how strictly HGVC enforces 5 people in a 1 bedroom - moths before could even book. I was basically called a criminal and advised people like me ruin other people’s vacations...
When you buy a TS there is commitment involved. I understand that circumstances do change. If you're willing to forgo that (financial) commitment you probably shouldn’t travel on that TS.

I fogot to pay my club fees one year because it was billed to secondary membership that is eoy. Forgot all about it as I paid my mf on the other memberships and did not notice club dues were not billed. By the end of Feb, my online account was locked up and I had to call member services to get access. I would not expect to have access to reservation past 30 days if I did not pay my loan obligation.

Info removed. To the OP. I had info to help you but I just realized that you were considering going to Hawaii using a reservation that you hadn't paid for. (Someone has to pay for that and it's the owners.) You also said you had financial hardship but apparently you have enough money to travel to Hawaii.

I don't mind helping someone who really needs help - the elderly, the infirm, someone who truly has hardship - or when the developer is taking advantage of someone. But I will not be complicit or waste my time supporting your unethical behavior.

@CalGalTraveler My apologies I was trying to play out a scenario. Nothing Unethical. I'm current and still current. Bad scenario roll play. I appreciate your help. Working with Hilton right now. I can see if you don't want to provide support. Greatly appreciated and grateful.

But I like to know of any data points seeing people success story in validating the Foreclosure Vs Deed as you mentioned. I have yet not seen any data supporting that. Also I looked up Florida to confirm it is truly a "non-judicial, anti-deficiency state". No such data I could find online that states or confirm that.
