Sands of Kahana election for Board of Directors - I need your help

The Sands of Kahana sent me my ballot for the Board of Directors. I am running for the board. There are 3 candidates running for two positions. I am one of the candidates. In my "bio" I indicated what I thought were pertinent issues to the Sands owner. One candidate runs several businesses with over 2000 employees. (It is surprising to me that he has time to actively participate on the board). The other candidate is a Las Vegas area realtor. Neither of those candidates indicated what their priorities are for the Sands. Neither of them seem to have much experience as a timeshare owner/user. According some other people, the last candidate doesn't even own at the Sands.

All 3 of us are considered eligible candidates. I was interviewed over the telephone. BUT, once again the SOKVC did not put my name on the Proxy. They are requiring people to write in my name. My opinion of that? Well, if I am handed a ballot for the November Presidential election and my candidate's name has to be written in, I would consider that to be unethical (and in the case of a national election also illegal). But that is essentially what the SOKVC BOD has done to put me at a disadvantage and to promote their hand-picked candidates.

I own several other premium timeshares (Marriotts) and stay in at least eight timeshares a year, so I have a lot of experience regarding timeshare quality, how the Sands stacks up, and actions that could be taken to improve the value of our timeshares and our on-island enjoyment. When I have noticed problems (e.g., rodents, bugs, water intrusion/blistering, etc.) I have communicated those problems to Soleil management. It is my personal opinion that the SOKVC is afraid of me being on the board; perhaps it is a control issue. So, they have (in my opinion) hand picked candidates who will allow them to proceed with "business as usual".

If you are a Sands owner, please give me both of your write-in votes. I will promise to do the best that I can to represent you. If I am on the board, I will have a unique position of being able to communicate your concerns and/or accolades to the other board members.

I would agree, all candidates should be on the ballot unless you missed some sort of deadline to be included?

has the ballot already been created and mailed etc?

Hi Brian, Thanks for commenting.

No, I did not miss a deadline. I complied with all of the requirements. I submitted my bio on time, and was interviewed via telephone by the head of the election committee. On the ballot paperwork, it indicates that I was qualified as a viable candidate along with the other two candidates. But their names appear on the actual ballot and for me there is an underlined space for a write-in. So, in my opinion, I should have been on the actual ballot and owners should NOT have to write my name in. I'm sure that writing in my name causes some confusion and results in some people thinking that they can only vote for the two hand-picked candidates whose names appear.

This same thing has happened in the past. There have also been other "shenanigans" in the past (like no return address on the ballot/proxy, no return paid postage, etc.).

Yes, the ballot has been created and has been mailed out. I am hoping that through TUG I might be able to gain some much needed votes. I have been an owner at the Sands for 16 years.

BTW, most of the other directors are either employees of S o l e i l or its parent company, A S N Y. So, even if I gained a seat on the board, they would still control the board.

In the past, I have received a substantial number of votes, but never quite enough. Coincidentally, the ballots are counted by S o l e i l employees. No outside 3rd party or accounting firm. In my opinion - - Kind of like an incumbent party in a State or Federal election counting the votes for both parties.

That's terrible that SOK excluded you from the ballot. It was intentional, and of course the Las Vegas realtor is a plant who works for Soleil Management. Their offices and a few resorts Soleil manages are in Las Vegas. Stacking the board is exactly what management companies do.

not privy to hawaii laws as that state seems quite different from most in the real estate arena....but if it were florida I would already be drafting my complaint to the DPBR about the unlawful election etc. I see absolutely no valid reason that the incumbents would be the only candidates listed on the ballot, that screams of fraud.

are associations registered corporations in hawaii? are there state statutes that cover condo/hoas?

do your covenants or bylaws cover how the elections are handled?

I know that at the Westin on Maui many years ago, a Tugger who was also an attorney, was turned away by the BOD when he wanted to run for the board. So he did a little research and sent a letter to the BOD quoting the law to them, and they reluctantly put him on the ballot. He had a phone interview with the BOD and they were suspicious and unpleasant. He was not elected.
