Resale without a sales contract

So I won an auction on eBay last night, it seems everything is legit. The closing company sent me the deed, a maintenance fee statement, and a resort information form with information hand written.

they also sent me a PayPal request. Before paying, I asked about a sales contract. I was told there is no contract to fill out. Has anyone ever purchased a timeshare without a sales contract? That seems extremely odd. After being screwed over by GC Getaways on ebay (more to come on that). I’m a bit apprehensive about paying a few hundred bucks without a sales contract. Especially with PayPal and eBay most Iikely not guaranteeing anything.

anyone have any thoughts on this?

I did one with no sales contract and it was my smoothest closing.

There was less than $400 involved, so I wasn't about to hire a lawyer or travel out of state to sue.

It was with Timeshares Cures on ebay.

I have purchased w/out a Sales contract via EBay. We had emails, Estoppel, and invoices.

Thanks! Yeah it was under 500 with closing. I saw the deed and estoppel so I paid and hopefully it all goes smoothly. Looking forward to this unit. It turned out to be better than the listing (they had wrong info on ebay). Just a minor detail of it being annual instead of EOY so it works out for me.

I would not list timeshare in the paypal description but only the ebay item number. Everything was complete in my case in about two weeks. I was able to confirm everything with the resort at the beginning and end of the process. It's a little risky since paypal does not allow timeshare purchases on its platform, but I think they would get your money back if things went south. Good luck.

I would ask lots of questions to get a sense if you are dealing with the real owners and make a quick call to the hoa/resort to verify as much as you can about the TS. Good luck.
Thanks. The estoppel matches the deed sent and resort information. Everything looked great. Just hope it goes smoothly.

I too have purchased on ebay w/o a "sales contract". But... in effect there was (probably) the legal definition of a "Contract". Their was the listing (An "Offer"). I bid on it and won (An "Acceptance"), and I provided "Consideration". I think that all of this makes a contract. Even if there isn't a formal and separate piece of paper with the words "Contract" written on the top.

BTW, I am not a lawyer but I did take a class in post-grad school in Contract Law.

By not signing a contract, you may have an out (if you want) in the future. This is because “statute of frauds” (common name but imbedded in state legislatures under different terms) requires signature(s) proving acceptance with any real property (there are other situations as well).
