Recission Period Confusion

Hi all.
I purchased HGV Max yesterday and there are two recission periods on my contract.
One is 10 calendar days for where I purchased- Florida. And there is an addendum page that states the recission period is 7 business days for New York where I reside. Which recission period do I follow and reference in my recission letter?

It should be the longest of the two. Where you buy is really what matters. That said, it doesn't matter, you bought yesterday and can send your rescission letter out tomorrow. Only two days. Well within the 7.

That shouldn't be necessary. You can indicate you are rescinding in accordance with the contract and state law. But the important part is to just indicate you are rescinding and send it in within the allowed time. Suggest actually sending two letters. If they offer email or fax, do that. Then also send a USPS Certified Mail or USPS First Class Mail (stamp) with a Certificate of Mailing. First Class with Certificate of Mailing is pretty cheap. USPS Certified Mail can be slow and requires signature. A Certificate of Mailing is USPS post mark proof that you mailed something to an address on a specific date.

That works, but I highly recommend also sending a second copy USPS First Class Mail, just a stamp. Certified Mail is slow and carries other logistical challenges like requiring a signature. Mail can also get lost, even Certified Mail, so mailing two is always advised. People automatically think USPS Certified Mail is the best but USPS First Class with Certificate of Mailing is also legally recognized. The important part is getting the Certificate of Mailing. It only costs a couple dollars more to add it to a stamped envelope.

Welcome and congratulations on saving a lot of money. After your down payment is returned, you are welcome to come back and research purchasing resale. We will be happy to help you purchase a good resale. The salesperson make it sound like HGV products are only one but in fact there are 5 different TS systems. But there is no rush to purchase resale, so we suggest that you take your time should you still be interested.
 
Fed ex overnight signature required
USPS works just as well. While not likely to be an issue, anything signature required can be declined by the recipient. I would tend to avoid private companies over USPS just because USPS is legally recognized form of delivery in state law. It is also possible that delivery could be to a USPS PO box that might not be serviced by a private delivery company.
 
When I sent ours, the nice lady at our post office told me Certified is legally binding - signature not required. It comes with tracking. I also sent a copy of the letter regular mail, noted it was also sent certified. I have a photo of that regular one hand stamped with mailing date at the post office window

Any method through USPS would be legally binding. That isn't necessarily the concern. Certified works great, we just see a lot of stress from some people because it tends to be slow. Then one person I talked to was concerned because it was getting delivered after business hours and had sent it USPS Certified Mail. Certified Mail always requires a signature. Though I've had certified mail sent to me that they just left in a lock box.

I think this is where USPS First Class Mail with Certificate of Mailing is better. You actually get a post marked slip that shows the to and from with the postal carrier stamp and date and is legally recognized by the courts. The Certified Mail and photo would work too. While it's only a few dollars, Certificate of Mailing is about half the cost of Certified Mail. My main issue with Certified Mail is how slow it is as that can add stress to the situation. Though if you want comfort with proof of delivery, then you need some kind of tracking. There is no best or perfect method as it is the post marked date that really counts. I am sure many people just stuff it in an envelope with a stamp, call it a day and get by just fine.

So I faxed my letter and then sent it Certified Mail with Return Receipt. Also took photos of everything. Just a few hours later, the salesperson who sold me the timeshare texted me that she was notified that I canceled. Hope to get a full refund soon so I can finally breathe. 🙂

Now there is positive notification that your decision to cancel has been received. Enjoy your time/vaction. HGV will still take their time refunding your deposit but it will happen.
 
Buy resale and save thousands of dollars.

Wow...that was cool you got that text.
I know we did everything right in cancelling but I too will breathe a bit easier when the refund hits.
