Real Estate Lot in Rosarito Beach, Mexico

Hello Tuggers,

I'm looking for some helpful advice.

In speaking to my mom, I found out that my parents purchased an oceanview lot in Rosarito Beach, Mexico, in the 1990s. They paid taxes on it for a several years, but somehow, lost track of it, and it's been many years now since any taxes were paid. I do not know where the deed is. I do not know anything about Mexican law. Is there any hope that the lot still belongs to us, or has it gone back to the state? Can anyone recommend a Mexican lawyer who might be able to help us?

My hazy recollection is that non-Mexicans are not allowed to own property withing "X" miles of the ocean and that what one had to do was have a Mexican Entity own the property on their behalf. If I am right, there is a possibility your parents never received a Deed...

I think there were some regulations and that property held by non-Mexican citizens has to be in a Trust.

I know that this has been a hassle for a friend whose husband passed away and she and his kids are trying to dissolve that Trust. It was only in the deceased name - he was in the process of transferring it to just his wife when he passed, but the transfer was not completed. It is a condo in Puerto Penasco. They cannot sell it until it is in their names instead of his. (He did not put it into his personal Trust for some reason., but I know that the personal Trust is paying the MF & utilities on this one.) We drove her to PP several times to see the attorney and go to court. It has been a mess.

They also had a home in Ensenada in the big beachfront golf development - Playacar. It one had his personal Trust as the owner and they were able to sell it easily enough - especially since he had been renting it to someone that wanted to buy it.

After 40+ years of T/S ownership, I am no longer "an owner"
My sister "owned" beachfront land in Mexico as well. As I understand it, it's like the others said. Non-nationals cannot own land in Mexico, so she had a trust with her and a local "guy" for the ownership records. I believe the situation went sideways when one of the hurricanes destroyed the area, and they were left holding the bag to nothing.
