RCI Points & TS Termination

Ok heres my situation. I bought a TS from the developer back in Aug08. Right after of course I found this great resource and knew I paid way to much for it. The TS came with 83,000 RCI points. Right when I discovered I overpaid I contacted the developer and tried to cancel. After going back and forth and finally agreeing to forfeit my downpayment, the contract was terminated. The downpayment was for 10% of the cost of the TS roughly $1600, but I also paid first years maintenance which was another $700. I am still in the process of trying to get the maint fees refunded, but it looks doubtful.

Here is my question; it took three months to cancel the contract. In that time I logged into the RCI account to just poke around and check things out. It seems my points are still in my account and if I don't get my first years maintenance fees refunded. Aren't these points mine to use? or will they be taken away?

After doing research I found an RCI points TS on ebay for $1, so I will be getting another set of RCI points coming in Aug09, but I would like to know if these current points are mine or not.

Any insight appreciated.

Since you have not been refunded the maintenance fee for those points

they are yours to use. I own two RCI Points resorts. If I sold one of my RCI Points resorts, even though I no longer own the resort, if I did not choose to transfer the current points (with the current maintenance fee paid) to the new owner, then they are still my points to use or I could get reimbursed for the maintenance fee and have the current points transferred to the new owner. You're lucky your timeshare purchase was terminated. Welcome to TUG. Since you have points to use, you might want to play around with those points and do some more reading before making another purchase to decide if you like RCI Points and if they will fit your vacation needs.:hi:
