Powhatan Plantation Drowning

A 6 - year old New Jersey boy has drowned at Powhatan Plantation while vacationing with his family. James City County police and fire officials say the boy was pulled from the pool at Powhatan by a bystander around 9:25 p.m. Wednesday. Police did not identify the boy. The boy was taken to Williamsburg Sentra Regional Medical Center, where he was pronounced dead.
Police are investigating the drowning.
 
Could the owners(deeded) of the TS be held personally liable, if the insurance was inadequate to cover the damages for the loss of the childs life?
 
What a shame. My hearts go out to the family. If a bystander pulled the child out, I'm assuming the parents weren't around. Children should NEVER be in or around a pool unsupervised by a parent or guardian (not a lifeguard).
 
When we stayed at Powhatan a few years ago there were lifeguards required. The pool closed early evenings because of that.
