Hello does anyone have any updated information on how to cancel active agreements or know of anyone who has gotten out of an active agreement??
We went back the same night to cancel and they reminded us that we signed a waiver to cancel, which I have read here that this is an illegal action in Mexico???? We could cancel but we would lose the downpayment.
Please can anyone help us know what to do???
We are planning to send our contract back to Mayan Palace in Houston on the advice of MadCanuck posted on March 23, 2004. Any other details or recommendations are GREATLY APPRECIATED!!!!!!!!!

I haven't bought in Mexico, but I understand that having buyers sign a waiver of the right to rescind is illegal.

When did you buy? If it was within the past few days, send a letter & a fax or whatever you can find that will arrive quickly & have proof of delivery. In the letter say that you are canceling.

If you bought than a few days ago, then you will need to contact Profeco, the Mexican consumer agency. If you join TUG, you can search for Profeco on the boards here. You may also want to search the old TUG BBS, there were lots of posts about this there.

You have the right to rescind your contract within the five days and signing a waiver is illegal and void in Mexico. Please, check the following links here as you can find it all in there:

Follow instructions exactly how to do this and I would send a copy to Profeco too. The Profeco web site and email address is mentioned in one of these links too.

Is this right to recind also for active agreements?? This is what he told us we couldn't do a cancelation without losing our downpayment on. We went back 2 hours later and that was on the 24th of February. So as you see we are now past 5 days, of course we don't have any written documentation we were there again to cancel. So JudyS, I guess we maybe can't send a fax now perhaps??? I have read that some people on this forum, MadCanuck, have sent their entire contract back and sent documentation and letters to Profeco and a few other places like thier credit card company to dispute the charges and this is the route we have started. Please keep in touch, as I will. Thank you! :eek:

Signing a waiver is illegal in Mexico so you can get Profeco involved. I would write the resort a letter with a cc to Profeco and let them know that you found out that this waiver is illegal or better yet, call them and tell them that this is what you are going to do. Give them the name of the person you went to see when you wanted to cancel and when you went there.

I'll bet you too that you do not have a copy of this waiver either because most resorts do not give you this as they know darn well that this is illegal.

We notified our resort nine months later that we knew that signing a waiver was illegal and that they had defrauded us too. We got all our money back and never had to get Profeco involved in our case. Resorts may rather cancel the contract and letting you have your money back than getting involved with Profeco.

Who was your developer or resort? Some developers are harder to deal with than others, from what I understand.

There are some very recent links too of people who did this on their own without the help from Profeco and got their money back. Read the links that were posted earlier and good luck.

I am wondering if I can contact TechnicalBard from the old forum site?? He had dealt with Mayan Palace and used a paper trail to get what he wanted. Any help is again GREATLY appreciated!

Hello:

I believe you can still get out of the deal AND get all your money back...

it will take some work and research on your part, but it can be done.

Remember: even though you signed a paper that supposedly cancels your
right to cancel THAT IS A LIE. That paper you signed is a scam. Don't
worry about it.

And you went to the resort the next day to cancel and they wouldn't let you.
That is also a scam. You can still get your money back.
There is a websight run by the Mexican government that will get your money back....it is called PROFECO (the website is listed below) !!!
