Ocean Watch - deeded OceanSide Building weeks, but yielding Garden View reservations

I understand in the early days of OceanWatch during construction, some weeks were sold and deeded to an ocean side building but then yielded only Garden View reservations in a non-Ocean Side building. In summary and if true, the net result is that someone could unknowingly buy an Ocean Side week and then find access only to Garden View week reservations.

First, could this have happened? Second, does anyone have knowledge of which, if any, weeks may have been tarnished by this practice?

Incidentally, I hope the above scenario is untrue.

The deed spells out the Ultimate Occupancy provision. Whenever you buy at OceanWatch (Surfwatch too) you need to ask to see the original deed.

The most important thing I can say about the Ultimate Occupancy provisions is, speak only with Owner Modifications to verify if a Week is impacted. If the Seller has the original deed and can show it to you, great, that's confirmation and we'll be happy to help you interpret the related deed clauses. If not, neither the onsite resort personnel nor the reps who answer Owner Services calls will be able to help - in fact it's likely that they have never even heard the term, "Ultimate Occupancy."

There's nothing nefarious about Ultimate Occupancy deeds or provisions, which I can confidently say because I have owned two UO-affected deeds since SurfWatch's construction phases. They are not evidence of Marriott under- or over-selling any inventory, and with the build-outs of both OceanWatch and SurfWatch long done, the interim placements stopped happening years ago. The docs make it very clear how the provisions work, and Owner Modifications will be able to confirm. But because the Unit Number in a deed affected by UO does not correlate to the type of view being purchased, your questions to Owner Modifications must reference the deed number and not the Unit Number. Your question should be worded: "I am considering a purchase of a Week and the owner tells me that something called Ultimate Occupancy is in play. The deed number is ______ (get it from owner.) Can you please confirm the view type of this deed?"

FYI, I just confirmed via Chat on the website that the following contact info is still correct -
- the email address for Owner Modifications is owner.modifications@vacationclub.com
- to reach them by telephone call the usual Owner Services number and ask to be transferred to Owner Modifications
- for snail mail you can send it to the usual Owner Services address (Marriott Vacations Worldwide Owner Services; 310 Bearcat Drive; Salt Lake City, UT 84115-2544) but include "Attn: Owner Modifications."

It's somewhat interesting to me that the OP participated in the thread that you linked. I'll say again, there's nothing nefarious about UO provisions and related deeds, but if history is any indication then the OP isn't going to be any happier reading this thread than s/he was reading the linked one.

SueDonJ - Thanks for insight. I have a "Vacation Timeshare Ownership Deed" for the property which has a description of the property and a Property ID No. Can I use any of this to get to the deed number?

In my profile my Barony Beach Week is notated as "Deed ID: BB*1234*56*B" and my SurfWatch Weeks as "Deed ID: SF*7890*12*B" (but I changed the numbers for security.) The first two letters are self-explanatory resort id's, the first four numbers denote the Unit Number in the deed (and again, are immaterial in UO-impacted deeds,) the next two numbers denote the Week Number on the resort calendar that verifies the floating season, and I don't know what the B means on any of them.

In the MF's section of my account my Weeks are identified only as "Properties" but followed by the same formatted ID's as above. If that's the case with the identifying info you have, go ahead and use it when asking Owner Modifications about UO impacts. I think you probably have what you need but if not, maybe somebody who's familiar with what you're talking about can chime in.

Thanks again, I'll call Owner Modifications tomorrow. I have moved way ahead on this matter because of the kind responses from you and others.

I can't offer much but I do know that the "B" means every year.
