Two interesting portions from Section 2 of the Buyer's Acknowledgements for the new Marriott Maui Lahaina Towers:

FLOATING AND FIXED WEEKS - OV AND MV

"Further, as to Units in the Lahaina Tower, the Developer may not, with the exception of Time Periods in all Ocean Front Units and the 51st and 52nd Time Periods in Ocean View and Mountain/Garden View Units, grant Fixed Time Rights for more than sixty-five percent (65%) of the Time Periods in any one Use Year for all the Units of a particular Unit Type. In addition, with the exception of Time Periods in all Ocean Front Units and the 51st and 52nd Time Periods in Ocean View and Mountain/Garden View Units in the Lahaina Tower, the Developer may not grant Fixed Time Rights for more than sixty-five (65%) of the total number of weeks of a particular Time Period of a particular Unit Type within the Lahaina Tower."

LOCK-OFF - FLOATING WEEKS

"With respect to lock-off rights, because less than 100% of the Units in the Lahaina Tower which will be occupied by Owners with Floating Unit Rights are available for Lock-Off usage, there is no guarantee than an Owner with Floating Unit Rights will be able to confirm a reservation for use of a Lock-Off Unit. Furthermore, the ratio of Lock-Off Units to non-Lock-Off Units may increase or decrease over the course of developmentment of the Resort in the sole discretion of the Developer."

I just heard of an acquaintance who traded in their EY 2 BD OV floating Maui unit for an EY 2 BD floating OV unit in the new tower. They said their cost was $84,000, minus the $30,000 credit they received for their trade-in. Can this be right? Just wondering if the numbers I heard can be correct. A Marriott sales rep last October had confirmed the rumour I'd heard that pricing would be in the $80,000's, but I guess I just still find it hard to believe. Anyone know if this sounds right?
