Need Advice After Losing a Chargeback Claim

Hello Everyone,

I'm new to the forum. Had my timeshare for 10 years and used it only once. Tried donating the timeshare with 3 different companies and couldn't even give it away.

Here's my question in a nutshell: I initiated and lost a chargeback dispute with a timeshare ad company called Share Traders Unlimited (Brandon, FL). Is there anything else I can do to get the money back? Should I just leave it alone and eat the loss? Or, since they're refusing to pay back the money, should I sign and send in the paper contract and call them each week to see if there's any inquiries to rent my timeshare?

Their defense is that I agreed on their verification recording and since I didn't submit cancellation in writing within 7 days--too bad. My defense is while I did agree over the phone, I didn't get the paper contract until the 6th day, reviewed the contract on the 7th day and called to cancel on the 8th day. What time did I have to send in a written cancellation.

If you need more background to my question, please let me know and I'd be happy to give more details.

How Much Was The Fee

What was the amount of the fee for the ad listing?

You may have some recourse with one of the state consumer agencies.

Here are a few suggestions:

The Federal Trade Commision can be helpful. File a complaint with them and review their website for information. Here is their Website:

You can also check with your state's attorney general and they can often direct you to the right agency in your state.

File a Complaint with the Better Business Bureau.

If the amount of your damages is less than $5,000 (the amount may vary by state), you can sue the company in small claims court. [Collecting after you win may be a problem.]

I will file complaints and look into small claims.

I was wondering if I have a case. This company was bold enough to tell me to go ahead and call my credit card company. They're not backing down because of their "verification" recording and 7-day review period.

Is there anyone else who has gone through something similar?


Why don't you try using the timeshare in the meantime. Perhaps you might even like it.

I'll see what we can do. Maybe now is the time to use it. We didn't use it much before because our children (4 children now ages 6, 4, 4, 2) were still babies/toddlers. We would need to take a Grandma for help and it just seemed like more money to get us going there than we have.

I'll keep you all posted. :)

I agree. Try to use the timeshare. Trade into one within driving distance. Your kids are very small, but if you get a place with a nice playground and kiddie pool, they'll be happy and you will be able to relax. I'm sure there will be some down time. They do sleep, right?
And the older they get, the more they will love the trips. At least until they are teenagers. :rofl:

My situation is similar. I purchased a timeshare from the developer and when I got back to the states (TS was in Aruba) found this website and sent the cancel letter and disputed with my credit card company. The down payment and first years Maint Fee were credited back to me immediately while they investigated. After three months I lost the dispute and both charges were back on my account. I spoke to the timeshare developer and they agreed to cancel the contract if I forfeited my down payment. Down payment was $1600 and maint was $700. I am still going back and forth with the developer to try and get my maint fees ($700) back. Its been a month since they claimed to have issued the credit with their bank, but I have seen nothing. I am been checking everyday and sent them numerous emails, contacted my credit card company, so far everything has been a run around.

Any advice would be great.

I would accept cancelling the contract if they offered that! You got out cheap even if you have to pay the downpayment and the maintenance. Now look around and find a great deal. 2300 will be your initiation fee into the great world of timesharing.

File a complaint with the Florida AG's Consumer Protection Division and also with the Florida Real Estate Commission (which specifically regulates timeshare).
