My ex and I are transferring our deeded property back to Hilton (long story, lots of back and forth and very stressful). The transfer documents sent by Hilton show the registered title as my married name, but I've long since gone back to my maiden name so the docs are not correct. Do I need to go through the title change process and then get new transfer docs? Has anyone encountered this? Also, here in BC, Canada we cannot use Canadian notaries to execute docs for Hawaii (says so on the docs). We were referred to the US Embassy but they no longer notarize these sorts of transactions. We were thinking to take a trip down to Washington state and use a notary there - any Canadians out there that have done this? Thanks for any advice! p.s., I haven't contacted Hilton yet to advise of this dilemma as I wanted to see what others might have done in the same sitch.

Regarding the documents being in your former name, no, you do not need to go through any title change process and then have new documents prepared in order to successfully complete this transfer. Make sure you have proof of your former name with you (probably something in your dissolution agreement re the name change) as well as your ID when you get your signature notarized. I'd actually reach out to the title company that sent you the documents and advise them that your legal name now is ____ and no longer ____. They may have some other form they need you to sign or have notarized. IDK if they will do that, but they may have something for their paper trail.

Sorry, I can't help as to the best place to get the docs notarized; just be aware that the signature requirements needs to comply with the laws of the state where the real property is located. So, whatever those requirements are for signing real estate transfer documents for where you own (Hawaii), make sure whichever notary you are able to use complies with all instructions provided by the title company.

Thanks for your feedback. The docs came directly from Hilton Grand Vacations so I will reach out to them. Appreciate your help.
