Mountainside Lodge, Whistler, for sale - what does this mean for TUGgers?

We received an email from Shell Vacations on 4th February:

As a Shell Vacations Club member with Shell Owners Association – Pacific, we would like to provide you with an important update about the Mountainside Lodge resort in Whistler, British Columbia.

You may be aware that this resort has been facing financial challenges. Last year, the board made the decision to evaluate options for continuing operations.

In late January 2025, through the Superior Court of British Columbia, BDO was made the Administrator — an independent officer of the Court — for the resort to address these issues and find solutions moving forward. BDO is helping to provide a platform to continue operations and oversee the potential sale of the resort.

This is called a Restructuring Proceeding. It provides us with the opportunity to restructure in a stable and controlled environment, under the supervision of the Administrator and the Court. The official legal notice can be found here.

While BDO is overseeing the potential sale of the resort, the Court also approved us to continue operating business as usual, including delivering great vacations for our members and guests. We expect to know more about the potential sale in a few months.

If a purchase of our interest in the resort is finalized, we will coordinate with the purchaser to determine next steps. As a Shell Vacations Club member with interests in the Shell Owners Association – Pacific, we will continue to keep you informed as decisions are finalized.

In the meantime, if your vacation plans bring you to Whistler, we look forward to welcoming you to Mountainside Lodge!

I've now seen an online article that says that the sale should be completed by 29th May.

I know nothing about Canadian law so can anyone please give me some ideas about what the sale might mean for timeshares?

This is rather interesting, but the article dos tell you a lot about what is actually happening. It sounds like not all the units are for sale. The building and common areas are not fore sale, but 42 of the 93 units are. I am a lawyer in Canada. The article doesn't provide enough information to understand the basis of the legal proceeding, but it is likely an application under the Companies Creditors Arrangement Act.

I happen to be skiing in Whistler this week staying at the Twin Peaks. I was chatting a couple of owners last evening. They reported their property is going up for sale. The timeshare HOA had a vote and 70% voted in favour of dissolution. The property did a hard refresh two years ago. The HOA had a budget of $4M. They spent $10M and now have a large debt.

I have stayed at the Mountainside Lodge many times via Interval, mostly during early season when skiing is free in Whistler for Edge Card holders. Exchanges or getaways. It used to be a very good deal. Looks like it's going to end.
 
In fairness, most Tuggers do not own at any individual resort you name.
Right but most thread titles don't say "What does this mean for TUGgers?," which was the question I was answering.

I went through something similar a few years ago with Carriage Hills in Ontario, former Shell, also managed by Wyndham, was close to bankruptcy and BDO took care of the liquidation. In the end, it was sold to be repurposed (condos). The property was deeded so each deed owner got a small amount of money (depending on how many weeks owned) when it was sold. Not sure if this applies to the resort you are talking about...

I would think not much as most Tuggers do not own there.
My DW and I own three weeks at Mountainside Lodge and have for more than 30 years. We also own at Embarc / Club Intrawest / Hilton Grand.

We just received a letter saying that the BOD has accepted a bid and is awaiting approval of the bankruptcy court.

The big news is that the TS will no longer be accepting guests as of May 27, 2025
 
My DW and I own three weeks at Mountainside Lodge and have for more than 30 years. We also own at Embarc / Club Intrawest / Hilton Grand.

We just received a letter saying that the BOD has accepted a bid and is awaiting approval of the bankruptcy court.

The big news is that the TS will no longer be accepting guests as of May 27, 2025
Did they have a vote on this or just let you know what was happening after the fact?

At any rate, after 30 years of ownership I hope that you are satisfied with the outcome and with the ease of getting out from under the maintenance fees of three units.
 
We are deeded in Shell Hawaii. I have been to Mountainside once. Since Wyndham bought Shell things aren't as good, but I expect that since Hawaii is popular, they will just keep upping maintenance fees and few will deed back or otherwise walk.

We didn't know any of this. :(

I talked with the guest services mgr today and got some additional information. It seems it was the hotel side of the operation (Executive Inn) that was the successful bidder for the timeshare units (which makes sense). The timeshare units will need quite a bit of work so they won't likely be open/available right away after the transfer. As owners, we'll find out whether we have any claim on the purchase funds but I suspect that won't be the case after debts.

For those that have paid their maintenance fees but aren't able to use prior to the May 26th final day, we're supposed to get a refund of the MFs from BDO. I'm hoping that really is the case. It seems that any reservations between now and the mid-May date for deposit with an exchange company are likely being restricted or not honoured.
 
We deposited a Sept week many months ago, have already exchanged it. Not sure what, if anything, Interval will do.
