Marriott ROFR

HI I am hoping someone who has dealt with Marriott ROFR can help us. We got a buyer for one of our weeks and of course Marriott decided to exercise their ROFR - but they are not closing for 90 days and the maintenance fees are due now. Any ideas on how we can get Marriott to reimburse us the maintenance fees? The buyers were buying NOW so we would not have had to incur the almost 4K in maintenance fees. Now we have to pay the maintenance fees and I fear that Marriott will not reimburse us so in essence we gave it to them for free.

Every resale contract I've signed stipulated who was responsible for the maintenance fees for the year of first use.

DON'T pay the maintenance fees at all! This is especially true if you do not have 2025 use.

I sold to Marriott last year in September 2023.
It was in our contract that Marriott was responsible for 2024 maint fee.
I had them put the maint fee in escrow with the closing company LTT.
I paid the fee and when everything closed I got the purchase price plus the 2o24 maint fee I had paid.

we used red week and got the price we wanted and the maint fees paid and closing to be done this year and then Marriott did the ROFR so I am not sure what will happen now.

Any group you've worked with to sell a Marriott timeshare property? On another note, as I assume the PSU in your email address is for Penn State and We Are alums too, great game against the Terps and hoping for a win against the Ducks!

@PsuFrh Fairway Villas has no ROFR, your buyer will get the unit.

If it was in your contract that the buyer is paying for the 2025 maint fee then Marriott will reimburse you for that fee.
Marriott is the buyer and they will honor the contract.

I've only bought...and it was through three different eBay sellers and then some broker here advertising on TUG marketplace.

And yes...Class of '93. :cheer:

When i bought off of ebay, the seller included the mf and closing costs and transfer fees in the total price - so it would have a better chance of passing ROFR.

I've only bought...and it was through three different eBay sellers and then some broker here advertising on TUG marketplace.

Good to know. I'm the Class of '65; my kids were the classes of '90, '95 & '96. Penn State Proud!
