@TUGBrian @DeniseM @CalGalTraveler take a look. This weekend, I’m creating a spreadsheet with official links to states’ timeshare laws, as well as their statuses as to non-judicial, anti-deficiency foreclosures. In the meantime, I will just keep adding notes.

* Legal Disclaimer: This list and paraphrases of non-judicial, anti-deficiency timeshare foreclosure laws are to provide basic information on timeshare statutes. The list and paraphrases do not, nor are they intended to, render legal advice, nor are they an alternative for appropriate legal research. The referenced information constantly changes and evolves. Please consult appropriate legal counsel prior to any legal activities or signing any timeshare documents.

I am reading about the Commonwealth of Virginia TS Laws and there have been many, many new changes in the TS Laws in the Commonwealth effective October 1, 2019.

There are four (4) states that does not have timeshare resorts or TS laws. I have named three (3) of the states, Alaska , Wyoming & Vermont.

Thanks for letting me know. VA repealed the VA Timeshare Act, but passed the VA Real Estate Timeshare Act. The new link is here https://law.lis.virginia.gov/vacodepopularnames/virginia-real-estate-time-share-act1/

@Grammarhero this is fantastic information. It would be helpful to list by the state links those that have "Non-judicial, Anti-deficiency laws for TS"

For example, Nevada has such laws but not for timeshares. My understanding from @Fredflintstone is that Florida, South Carolina and California apply to TS. Any others?

Yes, CA is anti-deficiency as attached. As stated on the other thread, SC is also anti-deficiency, but defaulting TS owner should NOT object to a non-judicial foreclosure, as to reserve the anti-deficiency right. I will check FL and get back to you.

Interestingly, FL is also a state in which an objection to a non-judicial foreclosure waives those anti-deficiency protections.

Looks like VA state Sen. John S. Edwards (D) primarily wrote the new law.
