So, you think it is a wise decision to rescind? Why? Not questioning, just curious. I can tell you are an expert on all of this.
How do I save a fortune if I keep my deeded timeshare?
Everyone has been great on here. I have enjoyed our TS over the years. I like the larger rooms, the getaways with II etc. I just didn't want to spend anymore money on it as we are getting older.
I wouldn't mind keeping the deeded one if I had to, but I don't want to pay $10,000 in 20 years if I'm still alive. If, that is true of what he says about the MF going up.

if you discover it is a good idea down the road (you wont), you can always go back again. but what you CANT do after a few days is cancel.

I have 2 letters ready to go. Someone suggested sending 3 to make sure that nothing gets lost in the mail, but I'm going with 2. I will be going to the PO in about 2 hours and mail them away.

Here is our letter with some info left out.
After careful consideration we have decided to exercise our legal right to rescind our purchase of contract ######### which was sold to ############## on September 15, 2023. We acquired the timeshare from Capital Vacations (Capital Resorts Group) in Branson, Missouri.

We are still within the rescission period, so I am canceling this timeshare contract as per the terms of the contract.

We have decided to cancel for the following reasons:

We were told our maintenance fees would go up to almost $10,000 in 20 years for our deeded property of Stormy Point Village. After the meeting I spoke to other Stormy Point owners, and was told the rep was not telling us the truth.

To be clear, we want to terminate our timeshare agreement immediately. We would appreciate you sending us a formal confirmation that you received this letter within revocation time as we are sending 2 certified letters to make sure that nothing gets lost in the mail. Please also send us the information that you have refunded our down payment amount of $2,856.83 to the Mastercard on file.

Watching this Capitol Vacations takeover with interest. They have taken over as the mgmt company for the two TSs we own. One, previously was managed by VRI and the other by Trading Places.

They try to increase MF by 20% & I'll happily default.

I used to have two VRI resorts and thought they did a great job. I was sorry to see CV buy them.

I feel real bad for my wife. She was a wreck through all of this. I am pretty pissed that I would fall for it, but I am more pissed at him. To think they can sleep at night when they tell these lies. I guess it shows you what kind of a person he was.
I can tell you they are laughing about it, not worth your angst.

Congrats on rescinding! fyi you don 't ever have to give them a reason to rescind, you are never required by law to have one or to reveal one. And beware, they'll probably try to call you and talk you out of this rescission based on your stated reason. Don't even speak to them. They may or may not send you a formal confirmation of receipt.

You can also notify your credit card company that you expect a refund, and if you don't see a refund come through in a timely way, you can initiate a dispute.

I did rescind a developer points purchase back in 1997, and never regretted a moment of that.

I just kind of found a template online and added one of the reasons. I know they probably don't care how he lied, but that is just they way they do business I guess.

They absolutely do not care that he lied, they taught him that lie, and they will have another strategy to refute your stated reason. Do not respond if the call.

I'd visualize that salesperson getting chewed out for losing this deal and the ego blow they will experience when he has to pay the commission back.

There's a cosmic justice in this world and you're not alone.

Work on a joke about this experience and when you get that money back, take a vacation until you can laugh about it.

He didn’t get the commission, it is paid after the rescission period. do you really think a rescission is rare? I have a home in big timeshare resort. I have overheard the salesmen talk in the bar, restaurant, and golf course parking lot for 35 years. Many live in the neighborhood. To a professional salesmen this is so easy, because they don’t have to cold call, or go to you, you come to them.

I'd argue the Professional Salesperson, but I understand the sentiment.

These people seem to be more BS than truthful, and their training is there to lower your guard, get you to trust them... I think that's called a CON-fidence Man.. Might just be an odd coincidence.

Professional selling implies ethical treatment of the customer and a longevity in the industry as a "profession." This can be that, but I get the sense its more pump and dump, than consultive selling. Obviously the 90-minute part is used against the Buyer, even though it should make things easier for Buyer to walk away.

My thought if it's such a great deal, please offer in writing and me some time to review wit TUG and think about it... Just saying if it's the right thing wouldn't that make more sense?

Your conclusions and logic are sound and irrefutable, but the deceitful practices of developer-direct timeshare sales have been in place without change for many years now. The sales hyenas know full well that they can lie and obfuscate at will, since only the written content within the four corners of the contract is in any way legally binding. Sadly, these slimy and deceitful (but highly successful) sales practices of many (…most?) timeshare developers are unlikely to ever change.

The good news (for buyers who even bother to read through their materials after signing a contract) is that state laws provide post-purchase contract cancellation rights for a defined period of time, the longest being 10 days; (e.g. FL, TN). In most states, it’s 5-7 days, but in several states the contract rescission period is only 3 days!

Many years ago, a new sales Manager instituted a policy whereas sales staff were not to mention maintenance fees to new buyers,and other questionable practices. Several of the honest, long term sales staff moved to another local resort because of this are still working there.

Well, I can't believe it. I sent my 2 letters of rescind on Monday through USPS with certified mail, and on Friday, (wow snail mail) it got there in the morning. USPS didn't lose either one of them.
Anyway, by 1:25 in the afternoon that same day, only 3 hours after they arrived, I got an email for a refund receipt. No calls, no fuss, no nothing. I hope it's not too good to be true. I'll be checking my CC for the next couple of days for the refund.
So, thanks to this forum and all the GREAT people, I just saved over $25,000. THANK YOU. :banana::cheer::whooopie::hi::wave:

You can buy a pretty fantastic timeshare for 10% of that cost.

Plus the yearly maintenance fees.

Now, as is usually suggested to people like you who have just rescinded successfully, take your time and do research about TSs before buying (or even acquiring for free) a TS. Maybe even rent one for your next vacation so you can "try before you buy" and see if owning one is right for you.

He could sleep at night because he was able to make his mortgage/car/boat payment. At least he thought he could.

We own one. We own at Stormy Point Village and have owned for many years.

Seems like you get the idea then.

The only questions left are what do you want a TS for and what is the best way to get it?

You've set a high budget to work with and you can get some amazing deals. I think working with a realtor and asking what they recommend. Then compare their offerings to rofr.net as it is a powerful way to negotiate, bringing down the price to a reasonable level or convince you it’s a good enough deal.

Well done. Even the slimiest entities (Westgate being my own candidate for top contender) do not dare to defy the laws pertaining to contract rescission. :clap:

Never feel stupid this happened to you. The reason there are so many smart people on Tug to tell how to handle the rescission is because they had to do it once or twice or in my case maybe 4 times

I recently went to a Capital Vacations update on my Grand Crowne resort In Branson. The closer literally lied to my face about legality issues in the county of Taney. He then proceeded to literally call me stupid because I couldn’t understand what a great deal I was passing on. I was mainly insulted because he thought I would believe the lies they were presenting. We were in a private office with no other Fish around or I would have raised my voice and made a small scene just for the fun of it. They never did answer the question I went to the damn presentation to get answered. I got my loot and left and went to my shows and spent my 250.00 Amex card.

I‘ve experience my contract recession issues in only Beach locations lol. I still go to presentations because I know there is nothing they can possible sell me that I can’t buy resale if I think I need it that much. If the salesman gets too carried away I tell him my story about my last Mexico rescission and before it was done the US Marshall was in Mexico picking up a fugitive that was the president of the company. I received a full refund on my credit card by simply disputing the charge. The FBI eventually got involved and asked me to give them all the information on the guy and the sale. People did go to prison in the US and more than one. I believe the charge was crimes perpetrated on a U.S. citizen by a U.S. citizen.
