I wish I would have found this site when we were still in Mexico, I know I am past the 5 days, but I have regretted our purchase since we made it. On our honeymoon, they did a great job of serving us many margaritas and an "offer of a lifetime". Is there any way to get out of it if we are past the initial cancellation time? Any help, assistance, guidance is beyond appreciated. Thank you!

unfortunately if your rescission period has passed your only options are to become the squeakiest wheel ever and persuade them into letting you out of your contract (low chance of success, but not zero).... or stop paying.

I will preface by saying this: don't get sucked in by promises of help getting out of this contract. Any money or "taxes" you are asked to pay to get out is a scam.

To answer your question, answer from post #2 above is correct. You can ask them but that is unlikely to work(remember, don't pay anything). Or you could just stop paying, cancel the card or account and block them from billing you anymore. That first payment is gone. Tafar is a right to use (think membership club). You don't own anything. You stop paying, your membership ends and you walk.

The explanation of signing under some sort of duress because of alcohol consumption doesn't disqualify the contract. To have your credit card disqualify the charge you would be claiming fraud. You have 120 days to do this with your own VISA card. If your VISA does take your side and you get a refund then you still have the contract to deal with but since it's a Mexican contract it's only enforceable for the most part in Mexico.

Who cares as you note below they can't enforce the contract in the U.S.?

OP should definitely dispute with CC if that is how they paid deposit. Claim they intentionally intoxicated you with high levels of alcohol and who knows what? If true. Give honest details about how you felt after, if passed out later, or had headaches. Tell them they lied and defrauded you. If true. Let CC sort it out.

It would be better to only say it was fraud. The more you say the easier it is to find a reason to disqualify the claim.
