How can I tell if the Marriott Ko Olina Beach Club contract we’re potentially inheriting is fixed or floating from the deed?

My wife’s grandparents owned a deeded interest at Marriott’s Ko Olina Beach Club. We own DVC and have been given the option from the family to assume this Marriott contract if we want it. We want it if it’s fixed, and my wife thinks that it is. But, I’m looking at the deed and it mentions “fixed or floating” and is not at all clear which it is other than being every year.

Marriott was a little less than helpful during the short call I had with them today because we’re not (yet) the member.

There must be a way to tell if it’s a fixed week contract from the deed. Does anyone know where that’s located on the deed what it says?

I don't think Marriott sold any true fixed weeks at Ko'Olina. If they did they would be exceedingly rare. They did sell certain holiday weeks that are semi fixed. Meaning you can book that week, but your unit and checkin day still floats.

Shouldn’t Marriott be able to issue an estoppel that describes exactly what is owned? Also, since this will be inherited by family, it would be eligible to be enrolled, which might make it even more appealing.

Why don't you want it if it is floating? If you book when the window opens you can get whatever week you want.
