New to this forum and found resale here. TS realtor took our money 1.1k that was supposed to go towards mf. Now we're getting emails from title company letting us know the deed has been recorded but we have to pay mf in order to update their database. Title co. does not know who the realtor is since it was "gifted", and the realtor is ignoring our calls. Should I bite the bullet and pay the title company? I'm afraid if I pay, the realtor will not help us activate our account to access the timeshare. Thanks in advance.

Look at the estoppel, it will be clear on the estoppel if the MFs are paid.

How much is the charge? There is an activation fee that HGVC charges once a deed has changed hands. That is not part of the maintenance fees. Is it possible that this is the activation fee?

$1089. Not activation fee. Email from title co clearly states maint fees must be paid in full. We paid the mf to realtor, who was supposed to forward to owner to pay it in Jan2025 but a month later, the title co contacted us directly asking for mf pmt, I told her we sent pmt to realtor and she had no idea what I was talking about.

I then contacted the realtor who said he'll check on it because he sent the money to ts owner but that his wife (ts owner) was very ill. We decided to wait and give it time. After no response I filed complaint with BBB on realtor and two days he reached out saying he thought the money issue was resolved.

Long story short, we understand there's a separate HGVC activation fee of $675 as of Dec2024 ($715 maybe new amount?). We really want nothing to do the realtor and willing to pay mf to the title co. if it means just that. I'm just not sure how pay the activation fee because the realtor said it had to go through him.

In the realtor's defense he did save us money and got us out of 25k timeshare purchase.
 
Normally, in my experience, you pay nothing to the realtor. You pay the closing company who then issues funding to each respective party. How can this realtor not remember you paying them?

Hopefully, you have a way to prove that you paid the realtor and can provide that to the closing company.

They are correct though, you may need to pay the 2025 MFs, if you received points in 2025. You would not pay 2026 MFs though because HGV will bill you directly this fall for those. Did you get 2025 points?

Sometimes though, sellers will pitch in current year points as part of the deal so you don't pay the MFs.

Look at the estoppel. Hopefully, you received a current estoppel.
 
You may have to provide the funds for the MF fee to the company handling the closing. Like @HuskerATL said, that is usually the people that collect ALL the money in a real estate transaction and then disburse the money at closing to all parties according to the sale agreement.
You should let the title company know about the money you gave to the realtor, they will likely invite him to agree to send his payment or payment to the seller (if any) back to you to cover the initial money you sent. If his claim is that he sent that money to the owner and the owner didn't pay, that gets a little complicated. It may be to your benefit that the owner is his wife.
 
As @HuskerATL indicated above this is not following the usual process.
  1. Waiver of Right of First Refusal (ROFR) and Resort verification of current fees & usage usually occurs before the transfer documents are prepared.
  2. All payments are usually collected by a 3rd party (closing company) before the deed is recorded.
