HGVC rescission

My husband and I just found this forum after we signed contracts yesterday for a TS through HGVC. Realized we got duped into a much more expensive deal than we initially realized and had buyers remorse this morning. We are currently at the resort location that the rescission letter needs to be sent to so we went to the office and turned in an envelope with the stated address on our contract for our intent of rescission. It was with the same woman we signed our contract with the day before and she opened the letter, made a copy and provided us with a copy of our rescission letter with a hand written notation on top stating, "received by : (her name and signature) and dated." Do you feel that this is sufficient or should we still mail a copy of the letter as well?

Thank you for any advice and for saving us from a bad business deal :)

I think that works. They are good about the rescission process and since she copied it and added her name, signature, and dated it, I think you are good to go. Now your next step, if you are still interested in buying to HGV, is to research resale. You can look through the points guide to see the point requirements by season by location by unit size then think about what you need/want. Also, look at the maintenance fee sticky to get an idea of annual fees. Then you can think about whether you want to own in a specific location or get cheap points to use anywhere.

Yes! We still like the idea of HGVC but didn't like the sticker price for the ownership
Our "deal" was $17K, for 5440 points every other year (evens) with $1400 MF and 15,000 bonus points (which is what sold us). And then we looked on here and realized how resale was a much smarter idea haha

It should work, but why not cover your bases. USPS is the legal method to deliver your rescission letter. It only costs a few cents (or a few dollars for certified tracking). The address you delivered it to is probably not the same address that the letter is supposed to go to. I suspect the rescission address is somewhere in Orlando at the corporate office?

Send letter via how your contract tells you to send it. Sales people get paid rather quickly and what if she needs the money for rent and tosses your letter in the trash so her commission is paid next week? Sure you have proof of giving it to her, but it will take time and effort to sort it out. Just send the letter to the address via certified or UPS or Fedex like it tells you to.

smart move....that is a terrible deal. You can get a resale week for much cheaper and more points. The letter normally goes to a different location (address) than the sales office. I would suggest that you follow the rescission exactly as stated in your documentation. Cheap insurance because I wouldn't expect the salesperson to throw away your letter. I am also surprised that the salesperson didn't try to talk you out of the purchase.

I agree with those who say to mail it to the address stated in your contract.
Follow the terms of the contract to the letter (even if you did it a better way).

HGV is an upright company that will do the right thing, but...
Sales offices have nothing to do with processing rescissions,.
That's done at HQ. We read a story (here) about a sales office "losing" a notice.

I agree with those that say follow through with mailing the recession letter. While HGVC usually does the right thing, you don't want to risk any wriggle room on not following the instructions on how to submit your recession letter. This would be a big gamble that could be adverted by just mailing in the letter.

With $17,000 on the line you can bet that I would send it via USPS and use CERTIFIED MAIL

Doing so provides you with an official Postmark which will hold up in Court should you need to go that route. Who knows if that particular employee whom you handed it to is still employed today. Think of the hassle you will have to go thru if she isn't.......

You want to make sure you get confirmation of delivery or it’s possible they could say they never received it. Would HGVC do that? My guess is they won’t, but you don’t want to take any chances.
Legally you only need to show proof that you sent it -- paying for delivery confirmation is completely unnecessary. Plus, no one here has ever reported that HGV did not promptly processed a rescission. The chance of having an issue is practically nil.

Probably, but the small cost of return receipt would be worth it for the amount of money we’re talking about. At least to me it would be.
