I’ve gone through our ppwk on the thumb drive provided to us and found our notice of cancelation rights but the fields that contain the address, fax and email address of the developer that we should send our notice too, including our name fields as the signees is filled with gibberish. We can not edit this doc.

I did find a copy of the same form elsewhere on my thumb drive with addresses printed on it but it has a giant watermark on the form that reads “COPY VIEW” with a note that further states this is not an authoritive copy of this record, so I’m weary of how accurate any of those fields are. We also can not edit this doc to remove the watermark.

Can anyone confirm that the following info included on the watermarked form is indeed correct return info to rescind?

Marriott ownership resorts inc
Fax 808-883-8110
New owner administration
69-275 Waikoloa beach dr.,
Waikoloa beach hi 96738
Mvciwaikoloacd@vacationclub.com

Also. We bought in HI but live in CA. Do we use the HI cancelation info or the CA one or does it not matter? Will using the watermarked form be problematic or should we use the one printed with gibberish, and handwrite in the correct info?

You should not need a specific form to do a rescission. Just a short note telling them you want to cancel the transaction executed on a certain date with your names on it should do the trick. The address and email you mention match the ones on our form from 2020 and it went through successfully. I would send it to where you purchased. I assume that was at Waikoloa.

I've previously posted the address for MVC in Florida but I don't know if it would apply here.

It is important to follow the instructions, including the address to which you send your rescission. Of course, you may send multiple copies to the various addresses to insure you send one to the right place.

It is critical that everyone who signed the purchase agreement signs the rescission letter.

Send at least one of your copies by a method that generates a proof of mailing (you don't have to prove actual delivery; the relevant issue is whether you mailed the rescission on time).

The problem is that the OP doesn't know who to send it to. The contract don't contain this vital information.

Here is that post for reference. I think the address is the same for all MVC point purchases since they are in Florida. The OP should reach out to their agent to obtain a complete copy of the contract. MVC is getting sloppy and needs to be reported to the Florida AGs office for this crap.

Thank you! I will send to both addresses (the HI one on our watermarked form, and to their FL headquarters) for good measure.

Very nerve wrecking that the instructions for cancelation was left incomplete in our contract given the small window we have to work with. We really appreciate your help.

Once you find the specific address to rescind then make a copy of the front page of the contract and include it with your rescission letter. If in doubt to an address to send it to then send it to every one you come up with to cover your backside.

I suggest USPS CERTIFIED MAIL and save the Postmarked Receipt. Remember it is the date of mailing which counts (NOT when they receive it).

Allow 45 days for a refund.

congrats on finding TUG in time to rescind and save thousands!
