I need some very quick help as my offer expires tomorrow (January 9, 2016) and the letter simply indicates I need to have noticed by then. Does that mean I can send it via UPS by then, or with certified international mail by then or does it need to arrive to the office by that date ? Thank you very much in advice TUG users. See below for details of "Mutual Right of Cancellation of Time Share Purchase"

The exact wording says "TO CANCEL THIS TRANSACTION, MAIL OR DELIVER A SIGNED AND DATED COPY OF THIS CANCELLATION NOTICE OR ANY OTHER WRITTEN NOTICE, OR SEND A TELEGRAM TO: <ADDRESS> NO LATER THAN MIDNIGHT OF <January 9, 2016>

By date sent - don't panic, but get it done ASAP and follow instructions. SVO are not hard-asses about this, but better not to take chances.
good luck
(and congrats)

You need to mail it by the 9th with proof from the post office of the date. The date they receive it has no bearing on the rescission, but the fact that you mail it within the rescission time period has everything to do with a successful rescission.

Just to be clear:
I STRONGLY recommend sending your letter via USPS certified mail letter with receipt. USPS is recognized in all courts.

If you feel the need to fax, email or FedEx etc... that's up to you. But, it's the certified letter that really counts.

All materials (binders etc...) should be returned also (not sure about SVN) but they might charge you for them (if you got anything.) The return of any promotional materials is not necessary to be done by the deadline.

Congrats.

Now go mail it.

Suggest you change your first statement to agree with your later comment ... NOT REGISTERED LETTER ... that is for stock certificates and bonds .. that mail MUST be locked in a USPS safe when not being transported ... costs WAY MORE than a certified letter.... which legal proves MAILING and DELIVERY (and actually delivery to the correct address NOT required IF you also send a regular letter as noted on both letters and your copy).

Just a simple letter, nothing legalese:

I/We wish to exercise our right of rescission to cancel contract #_________ Dated Jan,__, 2016

Signed

___________ Husband

___________ Wife

Promotional materials to be returned under separate cover (and do it).
Make a copy of the signature page of the contract for identification purposes and include it with your letter.

Send it USPS Certified to the address you have

Welcome to TUG!

Jim
