I purchased a timeshare in Mexico on Tuesday March 16th. It’s now Saturday night. Is there anyway I can rescind?

From what I understand, Sunday is the only day considered a non business day in Mexico. I don't know how they technically count the business days, does the day you sign count as one? Mexico has a five day rescission period. Send out that letter first thing Monday morning anyway, nothing to lose. If you have a post office open tomorrow somewhere that will also post mark it that day, go tomorrow.

Or are you still in Mexico?

If you are still there, you have no choice but to write a rescission letter longhand and try to deliver it to Customer Service and get someone to sign for it. DO NOT take it to Sales. They will NOT help you. Good Luck!

If I send out a rescinding letter first thing Monday morning and Monday is considered the Fifth day, would they have to honor it?

Saturday is considered a business day. The question is, do they consider the day of signing as one of the five days.

Looks like someone needs to stop going to timeshare sales presentations. No amount of freebies is worth the stress.

This is the second time you purchased and are rescinding?? Oh boy, you need to stop going to sales pitches. Good luck with this one. Hope you rescind correctly or you’re SOL with a timeshare in Mexico.

It really doesn't matter at this point. Reason: If you find you can't get it Postmarked on Sunday, then you have no choice but to have it Postmarked on Monday, and hope that it will be sufficient for a valid cancellation. The worst they can say is no, You won't actually know until you actually attempt to do so.

Me personally? I would make the attempt. You'll likely be saving a lot of $$$$$. And, it may be something which can be purchased on the resale market for just pennies on the dollar (every reason you should attempt to rescind).

Keep in mind that you aren't buying a deeded Mexican Timeshare. What you are buying is a RTU Property (Right to Use Property) for "X" number of years.

Finally, think about spending $15 and becoming a member of TUG. It will be one of your best and cheapest investment.

Sunday is the 5th day, and since it's Sunday and not an official 'Business' day, you can send the letter with Monday's timestamped postmark, but Debra, you're cutting this awfully close. Relying on a technicality is not a good plan, but LEGALLY you win. Do is a favor and let us know when you get your payment refunded. We'd like to tell others.

I would also send an email to Customer Service today and the signed letter first thing Monday morning. Check the contract - some state email is an option.

Is this an acceptable letter to rescind an RTU in Mexico?

This letter is to inform you that we want to exercise our right of rescission cancel our RTU (right to use) contract immediately that was purchased on March 16, 2021 at Pura Vidal Lifestyles Club for discounts and Services Affliation at Sunset Beach Resort in Cancun, Mexico contract package number xxx x-xxxx. We want a full refund of the amount of $3,900.00 and administrative fee of $1070.00 totaling $4,970.00 that was charged on an American Express card ending in xxxx. In addition, We also do not authorize any future additional charges to our bank account or credit card.

Additionally, this letter we be sent to memberservices@puravidalifestyles.com on Sunday 21, 2021 and be shipped by registered mail, return receipt on March 22, 2021 in recognizing the 5th day to rescind because Sunday is considered a non-working day.

This looks good enough to me. Contact Amex and let them know this is canceled. Maybe include Profeco denunciasprofeco@profeco.gob.mx to your email cancelation notice to member services so that member services can see Profeco has received this too.

Send the letter. Rescind/Cancel/Dispute the credit card payment. No one mentioned this or I missed it. This is extremely important. You must have a reason for rescinding, more than I changed my mind. Most times reasons are contract not what salesman promised. False or fraudulent statements by timeshare salesmen.
